Olivier Martinez says son Maceo wants to testify in Halle Berry custody dispute
Martinez says Maceo wants to discuss his custody wishes and an alleged September incident before a judge

Olivier Martinez says his 13 year old son, Maceo, wants to speak directly to a judge during his ongoing custody dispute with Halle Berry, according to court documents reported by PEOPLE on October 12, 2026.
In his latest declaration, the French actor said Maceo wants to explain his perspective on the former couple’s custody arrangements and an alleged incident on September 26. Martinez argued that the teenager should have an opportunity to discuss what he experienced.
“He should have the opportunity to have his voice heard regarding what he experienced that night,” Martinez wrote in the filing.
Martinez also expressed concern that Berry might oppose their son addressing the court directly. He described Maceo’s potential testimony as important to the court’s understanding of the disputed events. These statements represent Martinez’s position in the ongoing legal proceedings, rather than findings established by a court.
The custody dispute intensified after Martinez accused Berry of physically abusing their son in the September incident and requested sole custody. He also alleged other instances of abuse. Berry has strongly denied the accusations.
In a declaration filed on October 5, Berry stated that she had never physically, emotionally or otherwise abused Maceo. Through her attorney, Marina Beck, the actress described Martinez’s allegations as meritless and misleading.
Berry has also said she is a survivor of domestic violence and rejected the suggestion that she would harm her child. Her legal team said she remained focused on Maceo’s welfare and intended to challenge the allegations.
Berry’s older daughter, Nahla Ariela, 18, also addressed the dispute in a declaration filed on October 3. Nahla said she had never witnessed her mother physically abuse Maceo and described Berry as a loving and supportive parent.
The dispute remains a contested family court matter. Martinez’s request for their son to address the judge does not establish that the allegations against Berry are true, and Berry continues to deny them.
