Cardi B secures dismissal of 'Enough Miami' copyright case after court rules lack of jurisdiction

Cardi B has secured a legal victory after a Texas court dismissed a copyright infringement lawsuit related to her track Enough (Miami), citing jurisdictional issues and deficiencies in the claims.

The case was brought in 2024 by producers Joshua Fraustro and Miguel Aguilar, also known as Kemikal 956.

They alleged that elements of their 2021 song Greasy Frybread had been used without permission in Cardi B’s single. The lawsuit also named Atlantic Records and Warner Music Group as defendants.

According to court documents, the case was dismissed on March 30 primarily because the court lacked personal jurisdiction. The judge determined that the plaintiffs had not demonstrated that the Texas court had the authority to hear the case.

The ruling further stated that even if jurisdiction had been established, the claims would not have succeeded on their merits. The producers’ state-law claims were blocked as the federal Copyright Act preempted them.

In addition, the court dismissed the federal copyright infringement claims because the plaintiffs did not hold a registered copyright for Greasy Frybread at the time of the alleged infringement. This issue prevented the claims from proceeding under federal law.

The judge also ruled against the producers’ attempt to assert trade secret protections, noting that the song had already been publicly released on the FX series Reservation Dogs and on YouTube. As a result, it could not qualify as confidential material.

Requests from the plaintiffs to amend the complaint, seek a preliminary injunction and expedite discovery were denied by the court. It remains unclear whether the producers intend to refile the case in another jurisdiction.
