ATC takes tough line on case delays

Court issues strict orders in Radio Pakistan arson, explosives and narcotics cases

An Anti-Terrorism Court (ATC) in Peshawar on Saturday issued a series of key directives in three separate cases, including the high-profile Radio Pakistan Peshawar arson case, reflecting a tough judicial stance on delays, non-compliance and procedural irregularities.

The court adjourned all matters till January 26 while ordering progress reports and punitive action against those failing to follow court orders.

In the Radio Pakistan Peshawar attack case, linked to protests following the arrest of PTI founder Imran Khan, ATC Judge Wali Muhammad Khan directed the investigating officer to submit a complete progress report at the next hearing. The case pertains to the alleged attack on the Radio Pakistan building on May 9, during which protesters reportedly stormed the premises, set parts of the building on fire and damaged public and private property.

During the hearing, lawyers for the accused appeared along with Pakistan Broadcasting Corporation (PBC) counsel Shabbir Hussain Giggiani and Special Prosecutor and Additional Advocate General Muhammad Inam Yousafzai. The prosecution presented the notification appointing Yousafzai as special prosecutor; however, the PBC counsel raised a strong objection, arguing that Yousafzai had earlier represented two accused in the same case and, therefore, could not lawfully serve as special prosecutor.

Terming the appointment illegal, the defence sought its annulment. The court issued a formal notice to Yousafzai and sought his written response at the next hearing.
