Ashley St. Clair sues Elon Musk for paternity, seeks sole custody of their alleged child

Ashley St. Clair filed a paternity lawsuit against Elon Musk on Friday and is also requesting sole legal custody of her newborn son, according to court documents obtained by Page Six.
The 26-year-old stated in the petition that she began a relationship with the SpaceX CEO, 53, in May 2023. She claimed they were intimate on or around January 2 and January 3, 2024, which she believes is when her son was conceived. The official birth date and name of the child were redacted, but his first initial is listed as “R.”
St. Clair asserted in the filing that she is certain Musk is the father since she “did not have sexual intercourse with any other male during the time the child was conceived.”
She requested that the court mandate genetic testing for the Tesla CEO to confirm the child’s paternity.
To support her claim, St. Clair submitted a series of text messages to the court, which she says demonstrate her relationship with Musk and his acknowledgment of being the child's father.
According to the court documents, the new mother sent Musk a photo of herself holding the baby in the hospital, and he allegedly responded, “I look forward to seeing you and him this weekend.”
She further claimed that on November 24, 2024, Musk messaged her, “I want to knock you up again,” and as recently as February 2, he reiterated a similar statement, saying, “Well, we do have a legion of kids to make.”
Earlier this week, private messages between the two also resurfaced, showing them seemingly referencing various intimate positions.
St. Clair stated in the court documents that she is not currently asking for child support from Musk but has requested a temporary order for financial support on behalf of the child.
In an additional filing, the conservative commentator sought sole legal custody of her son.
“I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments,” she wrote in the documents.
“I am the only parent who cares for him on a daily basis. I feed him, bathe him and ensure that all his physical and emotional needs are met.”
She also alleged that Musk was absent during the child’s birth despite being given the chance to attend and has shown “no interest” in seeking custody.
