The Islamabad High Court has instructed the Deputy Superintendent of Adiala Jail to ensure that Imran Khan, the founder of PTI, is provided with all the facilities he is entitled to according to the jail manual.
The hearing was held in response to a request by Noreen Niazi for better facilities for the PTI founder in jail. The DIG of Prisons and the Deputy Superintendent of Adiala Jail appeared in court.
The Deputy Superintendent informed the court that all facilities have already been provided to the PTI founder under jail rules.
Justice Arbab Muhammad Tahir asked, "Who from the Prisons Department is present?" DIG Prisons Abdul Rauf responded that he is the DIG and mentioned that meetings with the PTI founder have already begun. The Deputy Superintendent of Adiala Jail reported that lawyers and family members visited the previous day, and all facilities have been provided.
Justice Arbab Muhammad Tahir asked, "Where is lawyer Shoaib Shaheen? He will confirm whether the facilities have been provided." The hearing was adjourned until Shoaib Shaheen arrived in court.
Justice Arbab Muhammad Tahir also directed that the PTI founder be provided with newspapers.
When the hearing resumed, Justice Arbab Muhammad Tahir stated, "Shoaib Shaheen, the jail officials say that meetings have been reinstated."
Shoaib Shaheen stated that the court should request an affidavit to ensure that meetings will continue without restrictions. Justice Arbab Tahir noted that, according to jail officials, meetings were restricted due to security concerns.
Shoaib Shaheen further explained that Justice Sardar Ijaz Ishaq had ordered that if there was a threat in jail, the PTI founder should be brought to the High Court.
"After that order, they were pleading with us to hold meetings inside the jail," Shoaib Shaheen said, adding that the PTI founder has still not been provided with newspapers.
Justice Arbab Muhammad Tahir asked, "Is there a provision for newspapers in the jail manual?" The Deputy Superintendent of Adiala Jail responded affirmatively, stating that newspapers are available in the jail. Justice Arbab Muhammad Tahir then warned the Deputy Superintendent not to create unnecessary complications for himself.
Advocate Shoaib Shaheen stated that the PTI founder is not even allowed to make phone calls to his sons. The Deputy Superintendent of Adiala Jail informed the court that the jail manual does not permit WhatsApp calls.
In response, Justice Arbab Muhammad Tahir instructed, "Whether it's a WhatsApp call or any other method, you should ensure communication takes place." Shoaib Shaheen added that the PTI founder had previously been allowed to speak with his sons over the phone.
On the other hand, Justice Saman Rafat Imtiaz of the Islamabad High Court has ordered the presentation of Azam Swati at 9 AM tomorrow in front of the court.
Azam Swati was represented by lawyers Ali Bukhari, Zakariya Arif, and Hassan Sajjad. He has filed protective bail for other cases as well.
GHQ attack case: Imran Khan to receive case documents on November 8
The Anti-Terrorism Court in Rawalpindi will provide Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan with case documents related to the May 9, 2023, attack on the GHQ on November 8.
The special court, presided over by Judge Amjad Ali Shah, held the hearing at Adiala Jail, where charge sheets were presented to 32 accused individuals, including several prominent PTI leaders.
Notable figures in attendance included Shibli Faraz, Sheikh Rashid Ahmed, Usman Dar, Sadaqat Abbasi, Waseq Qayyum, Zartaj Gul, Omar Ayub, Raja Basharat, Kanwal Shauzab, and Shireen Mazari.
The court was unable to distribute Imran Khan’s documents during the session due to its cancellation, and PTI lawyers refused to collect the documents on his behalf without direct instructions. PTI legal representative Faisal Malik stated, “We cannot accept the documents for our founding chairman without explicit guidance.”
The court instructed the absent accused to collect their documents within two days and confirmed that Imran Khan would receive his on November 8, with an indictment anticipated on the same day
