SC sends FPSC promotions case to services tribunal

ISLAMABAD:

The Supreme Court send a case regarding promotions of the employees in the Federal Public Service Commission (FPSC) to the services tribunal for correction of rules.

A three-member bench, headed by Chief Justice Gulzar Ahmed heard the petitions. During the hearing, the chief justice asked, is the FPSC such a superfluous institution that a watchman had been appointed as assistant director? Do watchmen also take CSS exams, he remarked.

Justice Ijazul Ahsan said that being able to just read and write is enough for the promotion to assistant director. The chief justice said that the FPSC is a big institution. An illiterate man has been appointed as the assistant director of the FPSC, he said, it tantamount to a conspiracy in such a big institution.

The counsel for the petitioner took told the court that according to the rules given in the report of the Establishment Division, a test has to be passed for promotion. At which, the chief justice said that the report then also says that pass the test for promotion even the educational qualification is zero.

The counsel said that the qualification for the post of assistant director, should at least be graduation. The chief justice said that according to the decision of the services tribunal, all promotions should be made under the 1990 Promotion Rules.

There are flaws in the services tribunal’s decision that need to be corrected, the chief justice observed. After the hearing, the court referred the case to the services tribunal for correction of the rules.
