The Supreme Court has been petitioned to try the President, the Prime Minister, the Army Chief, the Air Chief and Director General (DG) Inter Services Intelligence among others for high treason, conspiracy and criminal negligence concerning Pakistan’s sovereignty as well as the life and liberty of its citizens.
The petitioner, Muhammad Bashir contended that the US challenged the independence and sovereignty of Pakistan by conducting a surgical strike in its territory. He has requested the apex court to try the respondents under Article 6 for violating the constitution. The constitutional petition filed on Tuesday by his advocate, Ikram Chaudhary, under Article 184(3) of the constitution has also named Secretary Law, Chief Secretary and IG Khyber-Pakhtunkhwa and DG Intelligence Bureau as respondents in the case.
He has asked the court to order an independent judicial inquiry conducted by a judicial commission to investigate the events which culminated in Osama Bin Laden’s killing on Pakistan’s soil and to fix responsibility. The petitioner appealed to the court to declare that the respondents did not act in accordance with Article 4, 5, 8, 9 and 25 of the constitution, the provisions of law and the Army and Air Force Acts. He has also called for a stay on the inquiries ordered by the Army and Air Force Chiefs of the May 2 incident till the decision in this case.
