Raymond Davis pardon documents

The Express Tribune has received scanned copies of Raymond Davis’s signed application for settlement through blood-money (diyat).

The documents, which include the signatures of the families of the victims gunned down in Lahore can be viewed here.

Davis was released by a Sessions Judge Yousuf Aujla yesterday after the families of the victims pardoned Davis in exchange for blood money.

Federal Minister for Information Dr Firdous Ashiq Awan has said that the release of Davis after the payment of blood money is in accordance with Shariah Law.

raheel | 13 years ago | Reply First of all i agree from tarek that shariat applies only on muslims not for others and raymond davis release is not shocking for me because we the people of Pakistan does everything with bribe money. When a child is born we gave bribe to nursing staff to cut down his/her age to 2 or 5 years, then we give bribe to teachers to increase marks or leaking out the paper in matric or inter, then we gave bribe to get the admissions in the best universities, then we give bribe to get the jobs (These small things does have a great impact in our society). So basically there are two laws in Pakistan one for poor and one for rich so we have to clean this mess from our roots first.

Farakh Suhail | 13 years ago | Reply The Raymond Davis issue has finally been settled. After the families of the two victims pardoned Davis and settled the issue by accepting blood money. Each family was paid Rs 100 millions in compensation. Davis left the country the same day. The case was settled as per Pakistan’s Qisas and Diyat laws, which are ostensibly shariah laws. Qisas allows retaliation/retribution while Diyat allows the heirs of the victim to grant pardon to the accused in return for blood money. It is ironic to see that the same Islamists and right-wing forces who wanted Davis hanged are now twisting themselves in knots over the court’s verdict that was as per the same shariah laws they have been advocating for decades. Since they cannot object to the judgement in the Raymond Davis case because of the Islamic element in it, they have now resorted to their tired old mantra of ‘ghairat’ (honour).

Now the shoe is on the other foot and a rich non Muslim is benefitting from the Shari, in an open and independent court of PML-N Punjab govt, why are Muslims upset? You cannot hate Sharia when you don't like the decision, and love it when poor and minorities are killed. When our newspapers cut-and-paste from international news agencies, it is hard to figure what their point of view is...and spellings ae screwed up. MUHAMMAD KAUKAB | 13 years ago | Reply The debate on the release on Raymond Davis is motivated by the rightist political parties to make out a capital of an otherwise legal relief provided in our laws when the the amendment in the penal provisions relating to offenses against body was made in the PPC on the insistence of these rightist parties which privatized the murder as a crime against individual and not against State and the same can be be bargained between the parties. It was really a consternation to me when Ameer of Jamat-e-Islami gave the statement that the the murder committed by Raymond Davis was an offense against the State, then what jibe he has to say that 60 people have been killed in one week in Karachi and the same right wing leaders get the murders released in scant cases if they apprehended on the basis of the law of Qisas and Diyat. The layer community in Punjab who are demonstrating and calling a strike against the decision are either politically motivated or ignorant of the law who are calling upon to invoke Section 311 of the PPC are not well conversant to the Explanation appended to the Section and in any case it is attracted to the case of Raymond Davis case. If it is an emotional outburst then I will urge my learned Lawyer colleagues to establish the offense and not to make a political mileage out of it as he also deserves the justice which our law provide and if our law has provided a reprieve then its my legal right to avail the same. But the factum remains to be determined through investigation how the consent was obtained becomes irrelevant if the heirs have submitted the affidavits and given the statement to the effect that the compromise has been made without any coercion. I fail to understand as to why this issue of coercion is being raised in the presence of the explicit statement of the heirs conceding the agreement made. Now it is high time that these Ulema should proceed with a mission that the Murder should be made a crime against State so that a person should not be exonerated on the basis of Diyat or Qisas. Allama or Molvis plz join me in my mission and ensure that no murder goes unpunished but dont make a political capital out of it, the Court and the accused acted in accordance with law, so lets get together to change the law and dont let any Wadera to pressurize a Hari to sign a Compromise Document under his pressurize. which is a known fact.

They were delivered, also by unidentified men, to the court the day of the hearing, where each was asked by the judge if they pardoned Davis, and if they had received the blood money required under the country’s Sharia Law. Each reportedly applied affirmatively to both questions. The Express Tribune has stated that lawyers for the two families claim both families’ members were “forcibly taken to Kot Lahkpat Jail by unidentified men and made to sign papers pardoning Davis.” The 19 have subsequently vanished, leading to charges that they may well have been compelled to accept a deal, and have subsequently left the country, fearing retaliation from groups that were demanding that Davis face trial for murder. The lawyers for the family, who disclosed the size of the payment, say they too were held captive before the trial. “I and my associate were kept in forced detention for hours,” said the attorney for the family of one of the slain men, Faizan Haider.
