Forged degrees?: Fehmida Mirza goes to court

SHC directs the Provincial Law Officer to file comments on election petitions filed by NA Speaker Dr Fehmida Mirza.

KARACHI: The Sindh High Court directed the Provincial Law Officer to file comments on election petitions filed by National Assembly Speaker Dr Fehmida Mirza, challenging the Provincial Election Tribunal’s dismissal of her appeals on the eligibility of two rival candidates.

The Provincial Election Appellate Tribunal of the SHC allowed rival candidates Ali Bux Shah alias Papu Shah and Yasmin Shah to contest the 2008 general election from PS-57 Badin and NA-225 Badin, respectively.

Mirza stated that the BBA degree of her rival candidate Ali Bux Shah was fake because it had no affiliation in Pakistan, while his matriculation certificate was also declared fake by the BISE Hyderabad authorities. Therefore, he stood ineligible to contest the polls, she submitted.

Similarly, according to Mirza, Yasmin Shah was not eligible either because her BA degree from the University of Karachi was also fake. Her year of birth was mentioned as 1968 instead of 1965.

Mirza contended that the Provincial Election Tribunal, comprising Justice Khawaja Naveed Ahmed and Justice Khalid Ali Z Kazi, had not only dismissed her appeals, but also allowed ineligible candidates to contest the polls.

She thus prayed the court to declare illegal the acceptance of her rival candidates’ nominations. On Monday, Provincial Law Officer Saifullah submitted that he had not received copies of the appeals and thus he needed more time to obtain them. A division bench, headed by Justice Mohammad Athar Saeed, directed Advocate Anwar Mansoor Khan to supply the papers to the AAG. It then adjourned till February 28.
