PHC orders recruitment of Class-IV employee

Court also ordered health secretary to file reply on recruitment of ad hoc doctors

PESHAWAR: Justice Qaiser Rasheed of the Peshawar High Court ordered local government department secretary to either ensure the recruitment of Class-IV employees as per the rules and regulations till Friday (today) or appear before the court.

He observed that people at the helm of affairs in government departments would not be allowed to go against the law and would face stern action.

The bench was hearing a writ petition on Thursday. The petition was filed by Akhtar Ali through his counsel Muzammil Khan who challenged the recruitment of candidates from another union council on Class-IV vacancies advertised.



The counsel said the LG department has advertised 100 vacancies. According to the attorney, the petitioner applied for the post but was ignored even though he fulfilled the criterion required in the advertisement. On the contrary, candidates from other UCs were recruited. LG department’s chief planning officer appeared before the court and said the petitioner, who is already serving as Class-IV employee at Swabi UC, would be adjusted in his own union council.

Rasheed ordered the officer to ensure his adjustment till August 19 (Friday) and provide a notification in the court. If this is not done, the LG secretary should appear in person.

The same bench also ordered health secretary to file a reply on the recruitment of ad hoc over-aged doctors for different hospitals in Khyber-Pakhtunkhwa in violation of rules and regulations.

The bench, headed by Rasheed, heard a writ petition filed by Dr Abdul Samad and others through their counsel Javed Iqbal Gulbela. It was told that the petitioners obtained MBBS degrees from various universities in the province. The petitioners’ counsel said the health department has advertised and recruited over 1,000 ad hoc doctors for different hospitals in the province.
