Lawyer says four militants nominated in FIR yet to be arrested

PESHAWAR: The Peshawar High Court has issued a notice to the Khyber-Pakhtunkhwa advocate general and sought a reply from him over the bail applications of four people arrested under Protection of Pakistan Act, 2014.

Khairul Akbar, Noorul Amin, Waqif Ali and Saddam Hussain had filed their bail applications through their lawyer Arshad Ali Mohmand.

Mohmand told a bench – comprising Justice Irshad Qaiser and Justice Syed Afsar Shah – on Tuesday that the applicants were residents of Swabi. The lawyer added the four men were arrested in September 2014 for their alleged involvement in an attack on a police check post in Darand, Swabi.



According to Mohmand, the structure was damaged and four militants who belonged to banned outfits were nominated in the FIR. However, they have yet to be arrested.

The lawyer said the applicants were arrested even though they had not committed the crime. Meanwhile, PHC had granted a two-month period to the trial court to hear the case.

“Although [the time period passed long ago], the cases have yet to be heard,” Mohmand said. He requested the bench to release the applicants on bail.

After hearing the arguments, a notice was issued to the advocate general and his reply in the case was sought.

The 2014 legislation states protection must be provided against those who intend to wage a war or insurrection against Pakistan.
