KARACHI:
The Sindh High Court (SHC) called on Friday the original records on a piece of an amenity land in Gulistan-e-Jauhar, where a community hall is being built now.
Naveed Iqbal Sheikh, a resident of Saadabad Cooperative Housing Society in Gulistan-e-Jauhar Block 5, had taken the management of the society and the building controlling authority to the court for allotting and allowing construction over the piece of land in violation of the laws.
The petitioner's lawyer, Fazlur Rehman, said that the land in question, measuring 0.56 acres, was originally earmarked for a school or a park.
But the management of Saadabad Cooperative Housing Society has allotted the plot to Okhai Memon Jamat to build a community centre.
This is an illegal practice because an amenity plot cannot be utilised for any other purpose, Rehman argued, adding that secondly the plot cannot be allotted to anyone except the society's members. He also mentioned that there is a mosque on the adjacent plot, adding that the residents offering prayers will be disturbed by the wedding ceremonies if the community hall is built.
