SC seeks reply from IG Bani Amin and others on ‘serious illegalities’ in handling his ex-daughter-in-law’s murder case.

ISLAMABAD: The Supreme Court on Thursday issued notices to top officials of the Islamabad and Khyber-Pakhtunkhwa (K-P) police to explain “serious illegalities” in handling a murder case.

The case has already been compromised since the K-P police did not register an FIR even thought the incident took place in Peshawar, while the Islamabad police registered an FIR but later cancelled it, observed a three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry.

The bench took up an application filed by Zahida accusing her husband and son of killing her daughter Wahida. The complainant also accused Inspector General (IG) of Islamabad, Bani Amin of damaging the case. Wahida was divorced from Ali Bani Amin.

Appearing on court notice, Senior Superintendent of Police (SSP) Operations Yasin Farooq informed the court that a murder case had been registered with the Shalimar police station on IG Bani Amin’s orders on May 19, but cancelled the case after six days.



The SSP said IG Amin, Saddar SP Jamil Hashmi, Margalla DSP Rashid Niazi, Shalimar SHO Sajjad Haider and investigation officer (IO) Sub-Inspector Muhammad Rashid were responsible for registering the FIR.

K-P Police IG Ahsan Ghani admitted before the court that the incident took place in University Town, Peshawar and he could not justify the negligence of his force in failing to register a criminal case.

He said his subordinates informed him that the death was not unnatural and the forensic examiner’s report was awaited besides a postmortem.

The incident was noted in the daily diary of University Town police station despite the fact that Islamabad police chief had asked him to register a case.

Responding to the bench’s query, the K-P IG named Peshawar SSP Operations Imran Shahid, Cantonment SP Faisal, Assistant Superintendent of Police Umer Farooq, University Town SHO Sardar Muhammad and IO Rizwanullah as the officers responsible for not registering an FIR.

The bench comprising Justice Ijaz Ahmed Chaudhry and Justice Gulzar Ahmed issued notices to IG Amin and all the police officers held responsible for not following the law in the registration of a murder case and to explain their position till July 10.

Wahida’s younger sister, Farida stated before the bench that her father Darya Khan and her brother Khalid Rehman allegedly killed her mother.

“To oblige IG Amin, the K-P police did not register a murder case despite the fact there were clear marks of torture on the body and allowed him to take it to Islamabad.”

Defending himself, IG Amin said he repeatedly requested the K-P police to register a case if the death was unnatural and had the FIR registered in Islamabad only after they refused. I wanted to bury his daughter-in-law Wahida in Islamabad and her mother and sister came with the body and only raised a hue and cry at the time of burial, he added.

Pakistani judges and supreme court are just interested in creating news bites and drama. They can pass decisive orders if they are interested in justice but they are justice interested in giving dates.

Why is the court calling all the police officials. The judges know that the case was mishandles. All they have to do is to pass the judgement directing the relevant police authorities to register a FIR and investigate. It appears the judges want to make the police officials appear before the court and beg for mercy. I am afraid the day will come when the executive will strike back. Which will not be good for the justice system in Pakistan.
