Changes in law advocated for punishing vani perpetrators

Law and Justice Commission chaired by CJP Iftikhar Chaudhry directed the secretariat to propose amendments in the law.

The Law and Justice Commission (LJCP) chaired by Chief Justice Iftikhar Muhammad Chaudhry directed the secretariat to propose amendments in the law so that stringent action can be taken against perpetrators of vani and swara for dispute resolution.


The commission took serious note of the practice of giving women and young girls in marriage on the intervention of tribal councils to settle feuds and asked the LJCP secretariat to suggest changes in the relevant laws. The chief justice stressed the need for legislation on issues related to public importance and adapting existing laws to present requirements, while addressing a meeting of the commission on Saturday. He said laws need to be simplified for easy comprehension and inconsistencies should be removed. He urged that legislation should be passed in accordance with the procedure described in the constitution.

He stated that the system of administration of justice revolves around the provisions of the constitution which provides safeguards for fundamental rights of the citizens. It is, therefore, incumbent upon all the institutions to adhere to the provisions of the constitution in discharging their functions.

The commission examined the Law Reform Proposals for amendments in the Law and Justice Commission of Pakistan Ordinance, 1979 and recommended amendments for including the chief justice of Islamabad High Court (IHC) as member of the commission, empowering the LJCP to sign MoUs with foreign law commissions for conducting research and insertion of provision to allocate funds for Provincial Judicial Academies from the Access to Justice Development Fund.

The commission also recommended that amendment be made in the National Judicial (Policy Making) Committee Ordinance 2002 for including the IHC chief justice as member of the committee.
