Missing persons cases: Reports sought from home secretary, federal ministries

Peshawar High Court hears 19 cases of enforced disappearances.

PESHAWAR: The Peshawar High Court has issued directives to Khyber-Pakhtunkhwa home secretary as well as the federal interior and defence ministries to submit their reports in cases of several missing persons.

Chief Justice Mazhar Alam Miankhel and Justice Irshad Qaiser issued the orders on Thursday while hearing 19 cases of enforced disappearances. Additional Advocate General (AAG) Waqar Ahmad Khan and Deputy Attorney General Manzoor Khalil attended the hearing.

The court was told that Ishanullah, son of petitioner Fazal Mola, was picked up from Mardan on December 12, 2012, and to this day the family remains unaware of his whereabouts.

It is strange that the government is not submitting its replies, prompting the court to summon officials in person for a response, Justice Miankhel remarked.



He questioned if a procedure has been set for such cases, why was it not being followed.

The court was also told that Mir Afzal, son of Bas Bibi, was picked up on June 16, 2012 while he was heading to Landikotal, Khyber Agency. Afzal was later traced to the internment centre in Kohat.

AAG Khan was directed to produce the oversight board report of Afzal before the next date of hearing.

Similarly, petitioner Qamar Zamira’s relative also went missing some years ago. The court was told that the family filed an FIR against unidentified people and even reached out to the security forces but he has not yet been found.

AAG Khan said the case was in progress and the Commission of Inquiry on Enforced Disappearances has directed secret agencies to look for him in their respective jurisdictions.
