Unconstitutional: Petition filed against military courts

The petition was filed by the LHCBA president. He said that the Constitution did not provide room for military courts

LAHORE: Lahore High Court Bar Association filed a petition before the Supreme Court’s Lahore registry challenging the establishment of military courts.

The petition was filed by the LHCBA president. He said that the Constitution did not provide room for military courts.

He said by endorsing the 21st Constitutional Amendment, political parties had deviated from the basic structure of the Constitution and embraced a doctrine of necessity.

The LHCBA president said that the parliament could not draft any legislation contrary to the spirit of the Constitution.

The establishment of military courts negated the judiciary.
