‘Controversial’ move: IHC stays military accountant-general’s suspension

Court seeks reply from defence ministry, others

ISLAMABAD: Islamabad High Court (IHC) on Friday issued stay order against the suspension of top official of the military accounts department.

Justice Noorul Haq N Qureshi sought reply from top officials on a petition filed by accountant-general Farhad Khan against his suspension.

The court asked secretaries of establishment, finance divisions, ministry of defence, Controller General of Accounts (CGA) and Auditor-General of Pakistan (AGP) to file their replies till October 23.

The petitioner, through his counsel Saeed Khurshid said that the notification regarding his suspension was illegal.

The counsel maintained that his client was serving as military accountant general since October 2013. However, he was suspended on September 30 2014 for the period of three months without any reasons.

He said that even his client was not issued any show-cause notice before his suspension.

The petitioner’s counsel argued that the suspension notification was issued by CGA which is an attached department of the finance ministry. But military accountant general falls under the control of defence ministry which is the competent authority to issue a suspension notification.

He, however, argued, that defence ministry had not issued any summary for the suspension of his client, therefore it is illegal.

He informed the court that AGP had also declared the notification illegal.
