In his eight-page response, which was filed through two of his senior lawyers Hamid Khan and Ahmad Awais on Monday, the PTI chief said it would not be appropriate for a former CJP to enter into any personal litigation.
"We are aware that your focus has been rendering services to the country and never cared about making money. We are aware that in the past you have shown immense courage and tolerance in the face of expression that could otherwise cause mental agony and harassment particularly during the course of the lawyers’ movement for the restoration of judiciary," the reply stated.
It also said that Imran never meant to cause any mental torture or harassment to the former CJ.
“We deeply appreciate your desire to contribute to the causes of the downtrodden sections of society. Our client has always been working for public causes. He will also expect your contribution of such causes in the future,” the reply further said.
The PTI chief went on to appreciate the former chief justice’s directions, judgments and observations regarding the fair and free elections – however, his judgments, he pointed out, have not been implemented.
“We believe that whatever has been said to our client was an expression of disappointment due to the failure of the ECP and judiciary to dispense justice to him and his party. The language may not be appropriate, but unfortunately so is the nature of discourse during public meetings and political press conferences.”
The reply, however, said that the former CJ should have avoided addressing speeches to returning officers (ROs) and district returning officers (DROs) before elections, adding that the judiciary should have stayed away from the election process to establish the perception of neutrality.
Earlier, the former chief justice had sent a defamation notice worth Rs20 billion to Imran under section 8 of the Defamation Ordinance, 2002.
However, the retired justice added, he would withdraw his claim if the PTI chief tendered an unconditional apology or agreed to pay Rs20 billion within a period of 14 days.
In the notice, Chaudhry said Imran had defamed him as well as the judiciary by accusing him of rigging practices in the general elections.

we should sympathize with IK supporters(cronies) here for IK having had let them down .Poor guys have to come up with lots of funny excuses for IK defence. Unfortunately he is ndefensible,as he will take a U-turn before the previous one is completed and on and on.

The only silver lining on this whole scenario is that people now see him for who he really is and we now know he is not fit to be a PM or lead a country. And believe it or not, I am a former PTI support! I hope CJP continues his case against Imran Khan even forces him to resign from politics.
According to the intellectual Imran Khan's logic the burden of proof is always on the accused. If he charges somebody with a crime, it is up to them to prove themselves innocent. He does not have to give any proof.

I think Judiciary knows that they have been caught red handed, and are "barking" so loudly, in order to differentiate themselves from rest. Judiciary made their first mistake, when they took help of "democratic" parties against to fight the government at that time.
Now they are owed by the brothers.
Judiciary had a complete bystanders behavior, all along the elections. Of course, how would one accuse a person of rigging the elections, even if he can see it, when he owes to that person for struggling on roads and sponsoring his demonstrations.

The thing with IK being such an unthinking, loose canon (to the extent that I wonder if he has some sort of "syndrome") is that I'd be terrified to have him as our PM. The man does not think at all, not even a little bit. Does it ever cross his mind "hey, is this a smart thing to say" or "what will be the consequences?". Nope. All the lights are on, and the TV, and the sound system; but ain't nobody home.
Imagine if he were PM and did something this embarrassing on an international scale.

IK or PTI is not an investigative agency. The struggle is to get a meaningful investigation started. That is why it started from four constituencies and has reached this point. As an aggrieved party, one can file an FIR. No one replies to a FIR with a defamation notice. In this case, investigation has to be done by an authority that enjoys trust of all parties. The whole reply to the defamation responds to the language used by IK and not to the nature of allegations on ex CJ.
Please don't let this serial liar off the hook . He needs to be taught a lesson . Continue with defamation charge.
CJ Chaudhry should reject this lair's submission and press him to produce evidence of rigging. IK does not deserve to be let go that easily.

IK may well have circumstantial evidence the ex CJ but he rightly deduced that taking on Chaudhry with courts full of his friends and colleagues might be a recipe for disaster. Inelligent move well appreciated. Now, raise pressure on the Election Comission and the government fuctionaries involved in rigging, and ask people with evidence to come forward and speak up. This is time to rid our country of this disease of electoral fraud.

I think he is not taking a U Turn. Gicving a polite gesture to E-CJ for a shut up call as MR. Afzal has already said that in a telecast yesterday who were involved. I think Mr X should be gentle enough or all the previdileges assigned would be withdrawn. Getting a step back is not always loosing but it enables you to prapre for a step forward.
