The SHC on June 12 ordered the removal of Musharraf’s name from the ECL. The two-member bench of the SHC had itself suspended this order for around two weeks giving the federal government time to appeal against the decision before the Supreme Court.
Later, the federal government appealed to the court asking that Musharraf not be allowed to leave the country as he will not return.
Today, the Supreme Court suspended the SHC's decision and summoned the hearing of the case after four weeks.
The five-member bench of the Supreme Court said that the court on April 8, 2013 directed the government to make sure Musharraf remained in the country until initiation of a criminal case against him for subverting the Constitution. The order still holds to date.
Musharraf’s attorney general Farogh Naseem had earlier said that Musharraf wants to leave the country to visit his ailing mother, however, the members of the Supreme Court bench today said that Musharraf has various cases against him on which he is on bail and if he is allowed to leave there is no guarantee he will return for the hearings.

History will repeat itself soon and people of Pakistan will see again their well wisher in rule. My only fear is happy ending for current regime which they are themselves destroying. regards, sz
@sid:
Yes, we should let the Bangladeshi Supreme Court hear Musharraf's case then, right?! Childish or not, but this is the only court in the land which has the jurisdiction and Musharraf has to plead his case in front of this court. He should have thought twice about the integrity and biasness of these courts when he landed in Karachi to conquer Pakistan last year. But then again, this naughty establishment has a habit of pulling the rug from under anyone's feet.
Highly respected sir Musharraf please have patience and tolerance because PML-N's count down has been started and You and the whole nation shall hear the good news very soon Insha Allah Almighty......
@Sanity: Thank you for summing it up in a lucid manner. Sanity prevails on ET!
Noora Kushtee,no more .
Let us save Pakistan from terrorists .
@Munir: s
You do not get the message Sir! General Parvez is a refugee from India who as a General gave tough time to Punjabis civilians and military, it is now the Punjabis turn who control the armed forces and involved in cleansing operations. It is the military brass who are now dengrading the former Boss.

Why not transfer his mother to Pakistan on an air ambulance? Mush is rich enough to pay for it if he is really sincere in wanting to see his mother.
@Adnan Siddiqi: Whether you like Musharraf or not, the problem is that he is being tried by the same institution that he "allegedly" brought into dis-repute. Hence it's improbable they will ever give him justice (unless he buys it maybe?).
Also, for a Supreme court judge to say his "integrity" is enough for him to hear a case which involves a relative, just goes to show you the kind of mentality these Judges have. If the CJ had any credibility he should have sacked this particular judge for even allowing himself to hear a case involving a relative (no matter how far or close).
Hence Musharraf's trial is a laughing-stock!.. It makes the Judiciary look childish!
@salim:
I don't know about amending the constitution to punish other generals and abettors but the mother of all traitors and usurpers currently has his girth firmly in the grip of the law of the land and he should be made a quintessential example for those aspiring to violate the constitution.
@Mohammad: Any body and everybody did better than Yahya Khan and Zia ul Haq. For Musharraf and Ayub Khan there were short term gains but long term losses so it is nuetral at the best for these two. And whats your guarantee that next will not be Zia or Yahya. My friend world is moving forward with democracy , we should all try to make uit better not kill it. To argue in favour of dictatorships with no system to bring the better system in long term is just plain non sense and emtionalism which I understand in the face of non governance but is non sense niontheless.We should not go back .World will laugh at us . Time for dictatorships is gone.
The PML-N govt is naive as this is building army's opposition to the regime. Let Musharraf go and let NS reach an accord with Qadri to survive.
why no suo mota of of model town incidence,it seem Punjabi elite having immunity from judicial over sight ...
tom and Jerry game going on...
The SC has proven its bias. It took no time in ordering the government to put Musharraf's name on the ECL until the trial started. Now that it has started, it will take its sweet time in hearing the case - they took the full 2 weeks of the SHC suspended order and now will take another 4 weeks to set the hearings. We all know justice delayed is justice denied. No wonder people are fed up.
@Adnan Siddiqi: As a simple Pakistani, I was more comfortable at Mush time, when I had more purchase power, I could afford few outings and better quality of life to my childern unless these two so called democratic regimes chewed me up. I could see a madrassa student Adnan Kakakhel asking bitter questions and Mush giving logical ans, If Mush was unconstitutional then the present assemblies are too,, bcoz, before Mush There were 217 seats in NA, Mush made it 342, Age of voter was 21 years, Mush made it 18, bringing 200 million more voters,, He delayed for six months Lal Masjid crackdown, not like sharifs coming midnight at Molvis without warning and destroy those barriers which were ereced by LHC,, (isn't it contempt of courts??? but who cares, as mighty Ifti Arsalan given lucrative post in Bln)
Shambolic idiocy at all levels on display. Govt. for mismanaging handling of a non-entity i.e. TuQ; Political opponents of trying to gather political mileage from the events taking place and adding petrol to the flames at an extremely delicate and sensitive time for Pakistan. Military for not openly setting out its commitment to democracy and allowing fear of a coup to undermine stability and investor confidence. Journalists for picking sides in the fight and in effect acting as propaganda units for whomsoever they are backing. TuQ for being a miscreant and a trouble-maker; who appears to have some sort of agenda against Nawaz Sharif. The public for once again being overtaken by emotive sentiment and wishing for some glorious revolution. Have we not had enough revolutions already in our shorty history? Each being a step backwards.
Right now, Pakistan needs stability and focus on core areas: fighting terrorism, improving the economy and addressing the energy crisis. To ask a govt. to resolve these issues within year is a ludicrous demand. The current govt. appears to have a program that it is implementing; let it do so...in peace.
@salim:
" His Excellency the High and Mighty but untouchable Ifthikar Chaudhry for article 6? NO? Why?"
Why? Because the politicians you folks abhor the most, gave blanket indemnity in 2002 under 17th Amendment to everyone who stamped their validity on the PCO on 2000.
Just because others have not been charged yet does not make Musharraf innocent. The others will also get their day in court. But Musharraf should answer for his crimes by arguments and not by saying why so-and-so was also not charged.
@Shuaib: Despite its shortcomings and up against a vindictive judge leading the supreme court, PPP government was million times better than the current illegitimate regime. PMLN has broken all records of poor governance, massive corruption, nepotism, vindictiveness, terrorism, and persecution. This is precisely how they ruled in the 1990s before being kicked out.
@Waseem:
Ground reality is that instead of sitting in chilled rooms and liking the official Facebook of Musharraf by the thousands, the enlightened liberal trolls should come out on the roads and demand justice for Musharraf.
This is what Musharraf expected from all y'all last year when he landed in Karachi but you burger people let him down big time.
@Malikpur - Janderbari - Abbottabad: "however all those who have violated constitution and caused problem for country will face the results"
hehehehe, if this is it then your shareef leaders should be the first to "face the results" buying Mercedes from public money, killing people, lack of any accountability, is this not violation of constitution then what is??
You say like it's all milk and honey in the land of shareefs, hehehehe. Sorry I can only laugh, I have vented enough.
@Adnan Siddiqi: "As for your Murshid Musharraf, the guy is under indictment for usurping the constitution which carries the death penalty."
His Excellency the High and Mighty but untouchable Ifthikar Chaudhry for article 6? NO? Why?
Today's decision and the Live (but futile) dramas of #TUQ prove that we have a professional Army now and has absolutely no interest in meddling into politics. The constipated trolls of Musharraf have to learn the lesson from Turkey, as recently reported http://www.dawn.com/news/1113658/ 3 days ago. By punishing Musharraf a good precedent will be set in Pakistan to prove the supremacy of rule of Law. [There is not much difference between Taliban & Mush supporters; Both don't accept the Law and want decisions according to their Dictates] Rest in Peace the doctrine of necessity!
Look at ground reality (Musharraf's govt. delivered to common man and their welfare) and stop romanticising a piece of paper which is in fact failing Pakistanis and protecting the corrupt (who gave only unemployment, inflation, high debt, mismanagement etc etc etc). Please, be honest if you care about Pakistan's future.
@Malikpur - Janderbari - Abbottabad:
We are not in oppose of any government.... if they prove themselves sincere..or anyone can do better than Army.
Give me example..any government performed better than Army?
I am so disheartened to see such bigoted comments! What is wrong with our nation? Criticize - anything and everything! Everything is a conspiracy! EVERYTHING! Either the government is doing this or its doing that, it's responsible for this, for that! Where were you when PPP was ruling?
Good decision based on law and principles. But bad for. The govt. They should not have appealed. NS needs to learn politics.
As you sow so shall you reap
@Waseem: How childish and insane can you be!?!?!
How can the country let go of a convict who broke the constitution???
Pakistan needs yo establish it's writ as a state and such self-styled leaders need to be put in place.
@Waseem:
If Musharraf has so much vision, he should fight his case out in the same courts instead of feigning heart complications and deliberately shifting his mother to a hospital.
Purely Government decision. But it may be a good news because in such circumstances Army can take over and we may see Musharaf in the president house again. I am a bit confused that why our Honorable supreme court suspends/reject the HCs decisions, which even a little against PMLN. It was the judiciary for which nation struggled! My dear Pakistanis now its better to support Dr. T. Qadri. Long live Nawaz Court.
@Mohammad:
Judging from your rant that you possess a mind the size of a pea, Haqqani was never formally charged with treason. The case was still under hearing in the courts when he submitted his request to leave the country.
As for your Murshid Musharraf, the guy is under indictment for usurping the constitution which carries the death penalty.
these courts and their hide and seek has destroyed the nation. Don't judges see and have vision that Musharraf's rule was actually a public welfare time, the spirit of western democracy? Why hurting him for being an honest and nation loving leader?
someone is eager to come in and someone eager to go out !
No, govt is not going anywhere; however all those who have violated constitution and caused problem for country will face the results.... Gen Musharraf also came by getting support on facebook and now Tahir ul Qadri came to create space for his release but be sure this will not happen, Both stupid came but now difficult to return...
There was no guarantee for Haqqani too... why did you allow him to leave... HOW BIASED YOU CAN GO AGAINST MUSHARRAF.
This time army is going take the charge PERMANENTLY!!
Hold it tight Musharraf Sahib...the days of Govt are over...
