The Special Court on Friday reserved its decision on the request of former military ruler General Pervez Musharraf through which he sought access to the Federal Investigation Agency’s (FIA) inquiry and investigation report in the treason case.
A three member bench headed by Justice Faisal Arbab heard the case.
Presenting his arguments Musharraf’s legal counsel, Farogh Naseem, contended that abettors in the 2007 emergency rule should also be tried.
“This is a case of selective prosecution,” he said, adding, “FIA conducted inquiry and marked many other persons (as co-accused or abettors).”
He cited various judgments in favour of his request that the accused holds the right to access official data so he can make his case.
“This is a trial of far-reaching implications,” Naseem said, suggesting the court first decide this matter before proceeding further because the defence during trial is linked with this request.
