The Supreme Court on Wednesday declared the 2003 liquefied petroleum gas (LPG) quota agreement between the Sui Southern Gas Company (SSGC) and Jamshoro Joint Venture Limited (JJVL) ‘null and void’.
In its detailed verdict on the LPG quota case, the court termed the deal ‘non-transparent’ and ordered the recovery of all losses incurred. It directed the Federal Investigation Agency (FIA) to conduct a thorough probe and submit a report within a month.
“The report shall identify all those who are responsible for the failings, including the acts of criminal negligence, corruption, corrupt practices or other offences,” read the court order.
The verdict, which had been reserved on October 22, was issued by a bench headed by Chief Justice Iftikhar Chaudhry and comprising Justices Jawwad S Khawaja and Gulzar Ahmad. Justice Khawaja penned the judgment of the case, which was filed by incumbent Water and Power Minister Khawaja Asif in 2011.
During the hearing, a counsel for some of the respondents argued that the proceedings could not continue after the petitioner had been appointed a federal minister.
The bench, however, maintained that “we… are of the opinion… [that] this petition raises issues of vital public importance impacting the fundamental rights of the people, and therefore, must be heard.”
“It is by now well-settled that the court’s jurisdiction under Article 184(3) can be exercised even without a petitioner when information is laid before the court which justifies the exercise of such jurisdiction. Therefore, the proceedings can continue in the same manner as before,” the court order stated.
It said that the December 8, 2003 implementation agreement was awarded to JJVL in gross violation of the bidding process as advertised and set out in the tender documents.
“The project was awarded by SSGC in a highly non-transparent manner with the object of giving undue benefit to JJVL… The changes made in the implementation agreement were made with the object of giving unfair and unlawful benefit to JJVL at the cost of the state, state enterprise SSGC and ultimately, the people of Pakistan,” it added.
“The implementation agreement as executed between SSGC and JJVL cannot be allowed to continue, being based on illegalities from its very inception, and is accordingly set-aside with all consequential liabilities as are provided in the ‘corrected draft’ implementation agreement dated May 19, 2003… All losses caused to and incurred by the state, state enterprise SSGC and the people arising out of and as a result of the bidding process and during the tenure of implementation agreement are to be made good and recovered from JJVL, and all persons who had actively participated and had made substantial decisions in the bidding process and making of the implementation agreement,” the judgment stated.
Meanwhile, in a statement issued after the court’s verdict, the management of JJVL said it would exercise its right of appeal and was presently assessing legal and operational issues arising from the judgment.
The company said that it had strictly and faithfully complied with the law at all times. “It has previously and shall continue to comply with court orders. It shall also exercise its right to appeal the judgment.”
JJVL maintained that its agreement with SSGC was awarded competitively and transparently.

@FaiselH: The deal was struck in 2002. Iqbal Z Ahmed being Musharraf and Shortcut's buddy. The petitioner in the case is Khawaja Asif.
But alas, the Insafian mind will blame the PML-N.

Khawaja Asif has singlehandedly obliterated Pakistan's economy by pursuing this frivolous case. Not only will the economy suffer--and by all accounts it already has with a skyrocketing exchange rate and international investors pulling up stakes--but no entrepreneur in Pakistan will be inclined to invest money in a state that can steal their life savings even a decade after their initial investment! This man does not deserve to be in the cabinet...and he certainly doesn't deserve the all important water and power portfolio.
A wise move would have been to pursue the case, if he had evidence of any wrongdoing, through the proper channels within government. By pushing the court he has now established precedent and I shudder to think how the country will pay for his personal vendettas.
This judgement is a complete joke. It is yet more evidence of the nexus between the Chief Justice and Khawaja Asif. The Supreme Court has declared as illegal a contract signed in 2003 because it doesn’t like who set it up. Those who are celebrating this judgement out of some misplaced sense of socialism or jealousy should be very wary of the very real impact it will have on the investment climate in the country and on the energy sector in particular. It is ironic that while Nawaz Sharif is trying to lure investment in Pakistan, his blue-eyed minister has successfully killed power projects and now this oil and gas project. What is worse is that the judgement is seeking to nationalise the project! There is no sanctity of contracts signed between the private sector and the government any longer. It will be interesting to see how the next Supreme Court behaves towards the economy and whether JJVL will go for international arbitration like Karkey has done.
What @sami said is absolutely correct. Why there is Quota system in an Open Economy system. Why a different system has been implemented for LPG sector. Why not its market mechanism is similar to other petroleum products i.e petrol, Diesel, Gas etc. There should be no quota system and Govt/OGRA should fix the Prices. LPG should be available like any other Petroleum commodity. This sector has lot of potential but some vested interest has used it for their own purpose and casued Billions of loss to the country. Govt must act to liberalize this sector and get rid of few hands.

Ssgc and Jjvl deal was one the most corrupt deals. Jjvl project single handledly destroyed lpg sector development in pakistan. Jjvl/Iqbal z Ahmed secure contract from ssgc to extract lpg from ssgc natural gas pipelines on very very low rate and then sold it in market on super high margins bcuz of more demand and less supply. Awarded quota to every bureaucrat, politicians, army general.... Jjvl never let development of import of lpg in pakistan as any import increases supply and thus not allow Jjvl to make super normal profit from big supply - demand gap... I hope Supreme Court enforces this judgement ... Jjvl has made billions of dollars from this project in unfair way and also same time destroying energy sector development
