On November 5, a three-member bench of the apex court – headed by Chief Justice Iftikhar Muhammad Chaudhry - had observed that Defence Secretary Lt Gen (retd) Asif Yasin Malik had committed contempt of court by not holding elections as per the court’s earlier judgements.
Later on November 8, in an unprecedented move, another Supreme Court bench passed a stay against the previous order issued by the chief justice. The bench had stopped the action until a final decision of the appellate bench is made.
The stay order was issued after the defence secretary challenged Justice Chaudhry’s decision of indicting him.
The bench which had issued the stay order dismissed Malik’s appeal today.
