The SC bench that decided to dismiss the claim consisted of Justice Anwar Zaheer Jamali and Justice Sarmad Jalal Osmani.
Last year, on December 25, 20-year-old Shahzeb Khan was gunned down by Shahrukh Jatoi, who was accompanied by his friends, Siraj and Sajjad Talpur. The young men had a fight after the Talpur’s servant, Ghulam Murtaza Lashari, teased Shahzeb’s sister.
On June 7, Judge Ghulam Mustafa Memon of ATC-III had handed capital punishment to Shahrukh Jatoi and Nawab Siraj Talpur for murdering 20-year-old Shahzeb Khan.
The court had also given life imprisonment to Nawab Sajjad Talpur and Ghulam Murtaza Lashari.
On June 12, Shahrukh Jatoi had challenged the verdict by filing an appeal in the Sindh High Court.
The appeal filed by Advocate Shaukat Zubedi had stated that the conviction and sentence awarded to Shahrukh Jatoi was not justified by the evidence placed on record as the trial court’s judge had misread the evidence.
“Whenever doubts came up in the case, the court ruled in favour of the prosecution whereas according to the established principles of law, the benefit of the doubt is always given to the accused,” he had argued.
On September 9, Shahzeb’s parents – DSP Aurangzeb Khan and Ambreen Aurangzeb – had decided to pardon the culprits in the “name of Allah,” without claiming the amount of Diyat or Qisas.

He will not be hanged since capital punishment had been suspended by our beloved ex-president Zardari and has been upheld by our new love, Nawaz Sharif. So currently according to law, no one can be hanged, not even terrorists till the PM says so! What a country we live in!

If you are rich and powerful in Pakistan you can murder and go free...........this is the perception that is being being proved wrong and upto now it looks like justice is winning, lets hope they hold fast and take this to its final conclusion.

Please ask S.jatoi parent to give pardon to the person who will kill him in advance. The most of us will feel pride of doing this.
@jatoi; It means that the rich can kill anyone and spread terror and pay the Qisas for their killings. It is no argument for leaving such criminals in any way and Qisas is not be applicable in such killings. Islamic laws are to be respected without a doubt but bringing a criminal to justice, to set an example, for a heinous crime such as cold blooded murder, is justified itself. I live in Sindh and I dont agree SC should be accused of ethnic discrimination, if that was the case, many Shahrukh Jataois had been behind the bars or served death sentences. The courts are however deaf blind and lazy and ignore a lot of severer cases but that doesn't mean this one has also to be ignored.
You should also support his death sentence to set an example for a better society, init?

@Jatoi: I'm pretty sure that if someone killed you or your son, you would not only kill the guy but that too without a trial. In addition, you would most likely enslave the whole immediate and extended family and torture and rape them. Ofcourse, that will be all totally acceptable for you. As long as people like you exist, Pakistan is probably going to remain in the medieval times.
@roomi: Going against Islamic laws is disrespecting Pakistan's constitution. There are 1000's of death-row cases. Why is Supreme Court only interested in this case? Just because he is a Sindhi. He should be allowed to go free as the parents have forgiven him (and this is a false case against a Sindhi, anyway). Respect Islamic laws and respect the constitution, and stop ethnic discrimination.

shahzeb should be handed down capital punishment. it is the only way to stop wderashahi from flouting law at will. people like shahrukh consider Pakistan their personal property where they can do wotevr they would like to. these ppl should be taught in a strong way that pakistan is a state where law of the land is superior to anyone's wish or will.
Inn this case SC is biased and discriminatory. In thousands of similar cases murderers have been pardoned while SC never woke up from deep sleep. If parents of victim have pardoned killer of their son, under present laws no one can punish the killer. If Chief Justice has guts, he should change the law but he won't because he cannot face wrath of Mullahs. Our Judiciary is too afraid of terrorists and mullahs.

Knowing how things roll in pakistan, i would not be surprised to read soon that muk mukka has happened between SC and the culprits. I think the case is in the mode of negotiations.
Yet another case of SC and Pakistan in General targeting the Sindhis. The murder has not been proven in any clear manner and Shahrukh has been a victim of ethnic discrimination. Why is SC still interested in the case since the parents forgave Shahrukh anyway? Doesn't this stand against Islam and country's laws? President please take notice.

if jatoi have successfully done there bail from (SC) then Pakistani law totally disable to punishment of reach's (wadara's) who are the just for poisoning for Pakistan.

Name me one high-profile case/criminal in the past 65 years where the guilty offender(s) was actually punished...in any way. Salman Taseer murder? BB murder? Saleem Shahzad Murder? Gojra riots? Hindu being dug out of his resting place to be placed on the road for 5 days? Raymond Davis murders? This country and its people should not ask for justice because they only want it selectively. People like us don't deserve justice.
@Amna, what he did comes under terrorism, so as you said, even if his parents have forgiven him, it does not apply as per Islam, Islam takes terrorism very seriously and its punishment is beheading.

It wouldn't be more pleasing and satisfying if this Jatoi gets hanged to death- i might have developed some pity for him - MAY BE - if only he had shown some regret or shame - he didn't which means he has no conscience at all - he doesn't deserve to be called a human being ! even if the victim's family has forgiven him he shouldn't be forgiven for committing a crime against the state!!
This Animal should be HANGED in public without any further delay.
