Justice Faisal Arab, who headed the bench, passed this direction while disposing of Marwat’s plea against the election tribunal’s order for the verification.
The petitioner, who had won the general elections on PS-114, had challenged the order passed by the election tribunal, headed by Zafar Ahmed Khan Sherwani.
MQM’s losing candidate Rauf Siddiqui had obtained an order from the tribunal on August 3 for the verification of the voters' thumb impressions by the National Database and Registration Authority.
Marwat’s lawyer, Faisal Kamal, argued that the election tribunal's order was not in accordance with the law, as his client had not giving consent for the verification.
Disposing of the plea on Friday, the bench asked the petitioner to raise the issue of his non-consent for the verification of voters thumb impression before the election tribunal.
