Judges brought back to previous positions

The order will place these judges back to their 2009 positions.

PESHAWAR: The Khyber-Pakhtunkhwa (K-P) Services Tribunal has declared former chief justice Tariq Pervez’s decision to promote 21 senior judges to additional session judges null and void.

The tribunal’s chairperson Justice Yahya Afridi and member Justice Arshad Qaiser issued the order which will place these judges back to their 2009 positions. The Peshawar High Court’s administrative committee was also ordered to issue the decision to the 38 judges who were sidelined in the promotion process.

Advocate Ziaur Rehman, the counsel for five district and session judge petitioners, informed the tribunal that on August 13, 2009 (retd) CJ Pervez had ignored the seniority list and issued promotion orders although he was not authorised to do so. The tribunal, after hearing the arguments from the counsel of the petitioners, ordered that the decision was against the law.
