The Peshawar High Court (PHC) on Wednesday issued a notice to the superintendent of Kohat Jail, seeking an explanation regarding a person detained in the prison despite being acquitted.
A division bench comprising Justice Malik Manzoor Hussain and Justice Ikramullah Khan sought a reply from the superintendent after the court was informed Abdur Rauf was arrested for allegedly circulating inflammatory literature in Nowshera.
Petitioner Hidayatullah’s counsel Arif Jan informed the bench Rauf was arrested by security forces and handed over to the assistant political agent of Orakzai Agency who acquitted him after no charges could be proven against him. However, the man continues to languish in jail.
The court was also informed the political administration of Orakzai Agency wrote to the police department in Nowshera several times, saying if Rauf is not wanted for any crime he should be released.
The district police said Rauf was not required in any case and has been cleared of all charges. Upon this, the court sought an explanation from Kohat Prison’s superintendent.
