The division bench of IHC, comprising Justices Riaz Ahmed Khan and Shaukat Aziz Siddiqui, sought a reply from the state by June 4.
On May 22, the anti-terrorism court (ATC) rejected the post-arrest bail of the former president. Musharraf then filed a bail application in IHC, challenging the ATC’s decision.
During the course of hearing on Monday, Musharraf’s counsel Advocate Ilyas Siddiqi maintained that the court had rejected his client’s post-arrest bail despite the fact that terrorism charges do not apply in his case.
The petitioner's counsel further stated that there was no evidence against his client and he could not be declared culpable in this case. He added that charges under section 344 of the Pakistan Penal Code, under which he is being prosecuted, is a bailable offence.
Siddiqi informed the court that the main complainant Advocate Chaudhry Aslam Ghuman had withdrawn his complaint and disassociated himself from the case. The case is based on a First Information Report (FIR) registered against Musharraf on August 11, 2009 by the Secretariat police. IHC has fixed his application for May 27.
On April 18, Justice Shaukat Aziz Siddiqui had also rejected Musharraf’s bail application and he was arrested. He was shifted to his farmhouse in Chak Shahzad, after it was declared a sub-jail.
The police had also failed to submit a complete challan in this case where statements of judges detained in November 2007 are missing. The Secretariat police station house officer had approached the Supreme Court registrar but there has been no progress so far.

Since nothing can be done against Musarraf by judiciary or Govt. therefore all fundamentalist forces in the country are encouraging terrorists to attack on him or put pressure on him so that he can leave the country but Musarraf is Musarraf ,he knows how to die .He still commamds respect of the professional army of the country .This army is now commited to save the country from terrorits .The army has filtered out tetrorist supporters in Kargil war and challenged the terrorists in Lal masjid operation . Army now wants the solution of Kashmir issue at the earliest so that western border and the sovereignity and integrity of the country can be ensured and a prosperous Pakistan can be realized .
The catch is the statements of judges who were detained. Will the CJP and others appear in court as witnesses? Actually the FIR should have been lodged by them.They are having fun with Musharraf while he is around.
I wonder how these honourable judges have all the time in world to handle the big guys' cases in the fast lane. No time for the awam's cases. Motivation Publicity?

If justice is not done in his case then prepare yourself for another Bonaparte waiting in the wings to take over with the barell of the gun. Pakistanis has elected a civilian government and it should be the one to rule the country for the next 5 years and those whether military or civilians were involved in subverting the constitution should be brought to face justice, this is the only way Pakistan's nascent democracy could flourish in the years to come.
