A division bench of the Delhi High Court comprising Justice S R Butt and Justice S P Garg set aside the conviction and sentence of Iqbal Jan, a resident of Bandipora.
The Court came to conclusion that the conviction could not be sustained and set aside the same, ordering the immediate release of Jan and Mushtaq Ahmed Kaloo who was also convicted in the same case.
Jan has already spent seven years in Delhi's Tihar Jail. He was arrested by the Special Cell of Delhi Police on 27 November 2006 near Kauria Pul at Old Delhi Railway Station. A case was registered against him under the Unlawful Activities (Prevention) Act.
Earlier, his case had come up before another Division Bench and was argued by Panthers Party Patron, Bhim Singh. Later, it was referred to a Division Bench headed by Justice S R Butt who had reserved the Judgment on February 28, 2012.
Meanwhile, Bhim Singh has described the judgment as a "candlelight" for all those prisoners who still continue to be denied justice.

If we go along with your wishful thinking, all we will have will be more Sachhar Reports every so often. 66 years after independence, Muslims of India are still begging to be "lifted" when all the other minorities are thriving and making a name for themselves around the world.. What would happen if as many joined them?
@Singh: Good suggestion, BTW I have read history of Kashmir since all India Kashmir Committee's inception to the 1965 war when thousands died for what.........to control Kashmir!!! Kashmiris were exploited then and Kashmiris are exploited now, let them live in peace and harmony without interference.
@sm: No harm in that if it will save human being killed and improve general public conditions. Territories are a changing factor, not permanent.

I so very much wish that it can be undone. Indians and Pakistanis have so much to offer to each other. The land on the side of Pakistan would have developed more as an independent state of India. Good political move, now release the entire Kashmir before bloodshed from 2014 onwards. Save Indian Jawans and Kashmiri population for the sake of justice and humanity.

Good diplomatic move but unfortunately I feel the prisoners were better off and safe in the prisons. Now outside, lonely / alone with no education / money or even family , they will fall easy prey to terrorist of both sides I mean Pro and Anti Kashmir .

at last some justice for the kashmiris... thanks to the Indian High Court for making such a justice decision.
