While addressing the audience, the general maintained that all through his life, he had believed in taking plunges and expressed his wariness of thinking too much before taking a decision. In hindsight, it is revealing indeed of the kind of mindset that was steering the destiny of this country for a number of years, preferring plunges over deeper thinking and not looking beyond the obvious. Reflective of his words were the events of October 1999, when he wrapped up civilian rule and suspended the Constitution. He knew well about the red lines that he had crossed while subverting the constitutional process but at that time, we had a pliant judiciary, and later on, a compliant parliament to indemnify his acts.
In late 2006, a close associate of the former president, who held an important public office, wanted my take on the scenario that would emerge after the elections that were due in 2007. Before I could say something, he hastened to add that the president will be in a secure position in the follow-up term, too. The associate basically wanted me to carry out my analysis keeping that scenario in mind. I told him that I did not foresee any difficulty for the president or for the system he had crafted. There was, however, a caveat — any ‘unknown variable’ could trigger a chain of events, which might cause trouble for the ongoing dispensation. The president’s associate was not inclined towards buying my reasoning; even with the possibility of an unknown trigger, he believed that the system had developed sufficient capability to absorb such an eventuality.
Soon after, in March 2007, General (retd) Musharraf took another plunge and drove the country into yet another crisis. This time, he locked horns with the superior judiciary, which had granted him permission to contest the presidential election conditionally, as a petition over the issue of his eligibility was pending in the Court. A day before the expected judgment, he cast aside ‘reason and analysis’ and struck at the superior judiciary, plunging the country into an uncertain phase. The rest, as they say, is history.
In 2008, after his resignation as president in view of the impending impeachment, he went into self-exile and led a sedate life abroad. But then, Facebook cast a web of deception around him and he decided to take another plunge and returned despite saner advice to the contrary. He had been under an illusion created by his Facebook fans that a ‘Pakistani version of the Arab spring’ was awaiting him. Instead, as he landed, a string of criminal cases were waiting for him. His controversial proclamation of the emergency, the provisional constitutional order and the dismissal of senior judges in November 2007 were declared unconstitutional by the Supreme Court in July 2009 and these measures had not been indemnified by parliament either.
Musharraf surrendered before the magistrate’s court in Islamabad, which is a good sign. It is hoped that all the pillars of state will ensure that he gets a fair trial. He should be given every right to defend his position, after which, the rule of law should prevail. The whispers of tensions amongst the pillars of state should be debunked. Calls by Musharraf’s legal team regarding the opening of a Pandora’s box should be ignored. All this will hopefully help initiate a process of redefining civil-military relations with better clarity, for the greater good of Pakistan.

@GhostRider: Half of Justin Beiber's Twitter follower accounts were fake... Probably you also dont know that you can buy unlimited likes with money with political parties making multiple fake accounts to show their popularity. Secondly, Facebook is not a mark of somebody's literacy.. the kind of stuff which is shared on the social networks specially in Pakistan is always absolute rubbish with so called educated mindlessly sharing lies and fail to distinguish what is correct information and what is not. and mind you half of my village uses facebook-
@mrs ahmed: The Chief Justice's merits and demerits have nothin to do with the simple fact of Musharraf's suspension of the Constitution on 03 November 2007. That act amounted to subversion of the State and the Constitution and is an act of high treason for which law must take its due course. Please do not confuse reality just to justify Musharraf's wrong doings. If you do, you lose credibility.
Facebook fanbase might not be the correct indicator of popularity but it does show one thing, and that is the educated and literate people of the country are in favor of Musharraf. The poor uneducated majority have no voice because their opinion is formed by the feudals who rule over them.
This article hits the right note! Well done!
@Akbar: Sir when a man is so powerful to bring in any change, other just follow the orders.. the main thinking and strategy comes from the up.. a person Shoukat Aziz never had the guts to take such massive actions on his own.. he simply obeyed..
Yes rule of law is the most important factor , the saga began with the presidential refrence , against most pios cheep justice pakistan ever had. Had the supreme judicial council looked at it and given fair judgement over it, well wasn`t that the way to look at misconduct of judges, instead they cheep justice filed a petetion and got himself exonerated by the fellow judges who ignored the constitutional method.. I am amazed at the praise given to the judge , who thru undue means promoted his son , , look the most civilized section of society who are keepers of law have become lawless in this manner . Look at arsalan case , why did he not resinged at that time , wel he could not he is our cheep justice. Musharraf is given most biased treatment , lets see how long the sane elements remain quiet. I dont mean army , i mean the scholars and intelligentia. President Musharraf our lone spokes person in the international arena who speaks with conviction and confidence . Ok kill the lone soldier.
The most focal thing to concentrate on is his November 3, 2007 suspension and subversion of the State Constitution of Pakistan. Then being an absolute ruler with all power at his command, he created an unnecessary coup. That amounts to high treason and no question about it. And, the law on this is very clear. Therefore, he should be duly prescribed the punishment, as per law. Period.
@Zee Paki: really, so many supporters? why didnt they receive him at the airport? why arent they following him to court every day? why arent they having protests all over the country over his treatment? great followers indeed. your analysis of FB is the reason ur ex prez is in the current situation. dream on buddy!
The message of the article to me is to ensure prevalence of 'Rule of Law'.Musharraf's current nemisis stems from the July 31,2009 judgement of the SC in PCO judges case. Lets analyse its legal crendentials as per the maxim of 'Rule of Law'.Firstly, it comprised of the CJ and judges who had personal interest in the outcome of the case as they were the affected party of the PCO. Secondly,PCO judges about whom the case was all about, were not a party in the case nor were they heard.Thirdly, imposition of emergency of November 3,2007 and its twice validity by the SC was not the issue being dwelt on.Nor was Musharraf a party to it.The out come of the case was evident. The judges ruled in their own favour and even the CJ write his own name and declared the judgement of course in his own favour. The hearing and judgement of July 31,2009 could be called misconduct of those judges comprising the bench and against the prevalent law.It was as much an extra constitutional judgement as was the judgement of the SC on October 1999 take over. The author desire prevalent of rule of law but wants to build it on an extra constitutional or unconstitutinal base.Rule of Law has never stemmed from illegality.Either consider 'Past as Past' and start afresh for which prospects are healthy or build the foundation on a solid unquestionable legal base.Otherwise, results are highly likely to be catastrophic.
I could have not said it better, It certainly is informative and thought provoking. I appreciate your suggestion to the judiciary to make sure he gets a fair trial and let the world see that Pakistan too has world class higher judiciary. It is time that the elite in Pakistan start realizing that they are not above the law and the laws of the land must prevail if Pakistan ever going to be a stable country.
Pandora's Box to be ignored? Which planet does the author inhabit? The SC itself said sometime ago, "Let the Pandora's Box be opened."
It is laughable how all these anti-Musharraf writers/journalists have latched on to the Facebook phenomenon as they unanimously ridicule it. But they cannot explain why Musharraf has a lot more Facebook followers than the popular Imran Khan and why Nawaz who supposedly enjoys the most popularity according to them has less than 5% of Musharraf's on FB. Musharraf and supporter have repeatedly explained FB is but ONE of the indicators yet it does not get through their heads. If FB does not convince them I challenge them to go to ANY newspaper, find a Musharraf storyline and look at the readers comments. If you don't see 70% of the comments pro-Musharraf I will accept your rationale. Still not convinced? Free Musharraf from the judicial dictatorship, allow him to run in elections and then see what happens.
Biased article. Blaming one person for all the ills of generations.
Release Musharraf ASAP.
Your analysis reads true but the impression given is that all the blame is shouldered only by the man on top which in my opinion is not true.
