Contempt of court case: SC to hear Rehman Malik’s appeal tomorrow

CJ asks for stay order to avoid indicting former interior minister.

The Supreme Court on Wednesday formed a five-member larger bench to hear an intra-court appeal of contempt of court on March 29 against former interior minister Rehman Malik regarding the Pakistan Steel Mills corruption scandal in 2009.


A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry and comprising Justice Gulzar Ahmed and Justice Sheikh Azmat Saeed, was to formally indict the former interior minister for replacing the investigating team which was probing the corruption case in 2009.

Appearing on behalf of Malik, former Punjab governor Latif Khosa informed the apex court bench that an intra-court appeal was filed against the court’s March 18 order on charge sheeting Malik.

Chief Justice Chaudhry, however, asked the counsel whether he had obtained a stay order against the order and said if a stay order had not been obtained the bench could proceed to indict Malik.



Khosa replied that an application for the stay order was filed.

The Supreme Court had taken notice of Malik transferring the then director-general of the Federal Investigation Agency Tariq Khosa on December 17, 2009 before the completion of his court ordered assignment to recover the embezzled amount from Pakistan Steel Mills.

The bench then adjourned the hearing for March 29.

It is pertinent to mention that at the last hearing, Malik had tendered an unconditional apology before the Supreme Court in the contempt case against him for replacing the investigation team.
