Petition: Dissolution of K-P Assembly challenged at PHC

PESHAWAR:

The dissolution of the Khyber-Pakhtunkhwa (K-P) Assembly was challenged at the Peshawar High Court (PHC) on Wednesday.

Petitioner Shahid Orakzai termed the assembly’s dissolution premature and against the law, stating that though the assembly was dissolved under Article 112 of the Constitution, it was done a month prior to the constitutional expiration date of the government.

The petition read that former K-P chief minister Amir Haidar Khan Hoti violated Article 107 of the Constitution that protects the assembly’s term.

The petitioner contended the move was motivated by extraneous considerations and negated the provincial autonomy the Constitution guarantees.

Orakzai requested the court to accept the petition and restrain Chief Minister Justice (retired) Tariq Pervez from performing his duties until the Constitutional term of the assembly is completed.
