The army high command has already tried to convince the retired general to stay out of Pakistan. Ironically, the reason for rendering this advice is the same as the one Musharraf once gave to the late Benazir Bhutto: we cannot guarantee the security to your life and limb. These efforts to keep the former army chief away from the flight he wants to take on March 24 are still afoot. The retired general has used Saudi Arabia and UAE influence to strengthen his case for returning home. Not just that, his wish list also includes guarantees that he won’t be arrested upon arrival and that he will be allowed to participate in the elections. To pre-empt the possibility of arrest, pre-arrest warrants are being sought.
In case he comes back home and has an easy, trouble-free passage to the areas secured by his political supporters in Karachi, General Musharraf would pose an incredibly complex challenge to the army, whose present head, General Ashfaq Parvez Kayani, has become famous for attempting to detach the institution from the crippling and controversial legacy of his predecessor. If General Musharraf meets the fate that Benazir Bhutto did on that terrible day of terror six years ago, the onus of not being able to protect the former head of the army would fall on the shoulders of the present leadership. If he survives and continues to pursue his political ambition as a normal politician, it would be next to impossible to counter the impression that he has the blessing of the army. Both outcomes bring the army back into the realm of political controversy. Dead or alive, Musharraf would be a thorn in the side of the top brass.
Matters would get further complicated when the judiciary would take up the case of a man who once bullied the judges and tried to discard them in the true tradition of dictators. In a classic case of history turning tables, the institution that Musharraf tried to enslave now has the key to his liberty and future life. Rumours are doing the rounds that the “foreign factor” has already got assurances from the judiciary that they would be lenient towards him. These rumours are insulting and fly in the face of the image and perception the honourable judges have built over the years, of being completely independent. But these would only be killed by action. How a two-time coup-maker and destroyer of the Constitution is dealt with by the judges would be the litmus test of their independence. Courts that have summoned two elected prime ministers — disqualifying one of them, advised the president to behave constitutionally or else, taken on the mighty bureaucracy, ruled on the constitutionality of provincial governments, etc. will now be keenly watched for their approach towards Musharraf.
Politically, the Pakistan Muslim League-Nawaz (PML-N) will be tested by the Mush-factor more than any other party. Nawaz Sharif has practically made a career out of speaking about his ouster from power by General Musharraf and his subsequent exile. He has been fervent about enforcing Article 6 (sedition) of the Constitution so that future coup-makers are kept on a tight leash. With General Musharraf’s return to Pakistan, the stance that the PML-N takes will determine how true or false their interest in seeing General Musharraf getting punished is.
And finally, the media’s conduct, too, would come under detailed scrutiny. General Musharraf’s entourage already includes a few from his charmed circle. Others will make a beeline once he is in town. What editorial line media and publication houses take on Pakistan’s last surviving dictator, who supports him and who calls for his accountability will be a fascinating study in the media’s relationship with ethnic and political groups, besides the influence of money on editorial choices that individuals and groups exercise.

@Umair: Still it looks like you are out of tune and not in sync with the events as they unfolded. Long March of whoever he is, stopped at Gujranwala. Stayed there till announcement was made to restore judges. Have you forgotten that at 3am in the morning Gen Kiyani (COAS) left the President House and in minutes the announcement was made to rstore the judiciary, including the CJ. Anyway, the recommendations to your contribution shows how much it made sense. Check how many recommendations are under my contribution, then only you will appreciate my thoughts.

" The writer's question raises further the following question: If the Chief Justice of Pakistan were legally required or morally duty bound to take suo moto action against Musharraf's infringement of the Constitution and his extra-Constitutional measures, including the Provisional Constitutional Orders of 1999 and 2007, would the Honorable Iftikhar Muhammad Chaudhry be able to do so without any conflict of interest? If not how would it be possible to proceed against Musharraf's subversion of the State and its Constitution?

His arrival and participation in the elections would bring competition and people of Pakistan must decide his fate in Elections. Let him come and face the law of land.

Tv anchor Talat Hussain seems to be against Musharraf, Musharraf has never appeared on his talk show, very biased article,knit picking a few incidents, no mention of all the good mush did for Pakistan.
Nawaz Sharif would actually be happy to see him back. Musharraf would be the target for Nawaz to use during the election campaign. Nawaz would consider this return a blessing in disguise.

He stayed in the country for 6 months after the elections were completed. There were no cases filed against him at the time he left.
Musharraf usurped power and subverted the Constitution of the nation and with it the State of Pakistan itself. The PPP Government that followed did several things that favored him: 1) Showed leniency by not trying him for not providing adequate security to Benazir and/or orchestrating/abetting in her assassination. (The Government was itself not to keen on investigating the murder of Benazir.) 2) By letting him escape the country without due accountability. 3) Performed poorly and made democracy look bad and Musharraf's rule better or at least the lesser evil. In contrast, no one compares the democratic Governments' performance in the 1990's which were far better than the dictator's rule. Musharraf's economic slide was much worse than witnessed in the Governments of Benazir and Nawaz Sharif from 1988 to 1999, which performed much better. Even if there were any excuse to take over power, there was none to continue without democratization for a decade. Musharraf will go down in history as one of the greatest destroyers of Pakistan. He should be duly tried for subverting not just once but twice, the State and the Constitution of Pakistan.

Of many strange things one sees happening in Pakistan, Mussharraf actually returning to Pakistan and becoming a politician would be the strangest. In any other country on earth the man would be treated as a criminal and put behind bars for life.

Talat bhai, matter is not simple as you portrayed here. Problem is everyone has a past which is dirty and obnoxious. CJ was the one who took oath under PCO, Mr Nawaz Sharif was groomed by a dictator, Kayani was ISI head when lal masjid/bugti murder happened, media welcomed him when he was handed over Pakistan (remember he was in Air when coup was attempted). Laying blame on single person in my opinion would be biased. Court has already stopped the way of military coup in future. As far as Musharaf is concerned, let people make a choice. If people still elect him that means its not a single person fault, fault lies in our mentality, we as nation has a brought up which makes us believe in kingdomship/dictatorship or massiah.

Good or bad, let the people decide. Actually, you and all your colleagues in the free press today should be thankful to Musharraf. It is because of him yoy, Talat, has a cushy highly paid job; otherwise you would be selling newspapers or some small time teaboy in PTV. So, coupmaker or not, he was the person under whom you were born. So, keep it that way.

Well let us not forget that the same judiciary took oath under the dictator not once but twice. So if army will have a problem, I would guess judiciary will also have the same problem. It was only in the end they fell off from each other.
As far as Sharif is concerned, well it does not matter to him who is in election and who is not, according to charter of democracy, it is his turn to be PM, or atleast that is how he sees his position.

There is no such thing as Pre-arrest bail in the US, one commits a crime and he or she is arrested and then it is up to the judge to grant the bail, it is a good system although not perfect. Mush chose to leave the country instead of facing the court of law, he should not be given this so called Pre-arrest bail and should be hauled to jail regardless what his supported like Kasuris say. It is time that Pakistan could emulate South America, and bring this dictator to face the law and establish a precedence once for all if Pakistanis fail this time then expect future ambitious Generals to take over again and again.He must not get away with his crimes by violating the constitution of the country.
