‘Khar’s wife’ appeals jactitation of marriage decree

Petitioner wants Khar to pay her dower, maintenance.

A woman, claiming to be a wife of Ghulam Mustafa Khar, a politician, has filed an appeal against the dismissal of a suit she had filed for the recovery of dower and a plea that Khar be directed to pay maintenance.

The appeal was filed before an additional district and sessions judge, who on Tuesday summoned court record for March 4.

Advocate Shahid Maqbool Shaikh submitted a power of attorney signed by Khar, appointing him as his lawyer, before the judge after the politician was issued notices by the court.

The petitioner, identified in the petition as Neelofar, says that she married to Khar in 2004. The dower was set at Rs2.5 million, a one-kanal house in Johar Town, Lahore and 110-tolas of gold. Khar also agreed to paying Rs20,000 as maintenance.

In reply, Khar had filed a suit for jactitation of marriage. He contended that the nikah nama had been forged “for ulterior motives”.

The petitioner claims that she had provided the court with a list of witnesses, NADRA record and a CD with photographs of Khar and her as a couple. However, the court did not record the witnesses’ statements. She says that the ‘closure of evidence’ was illegal.

The court had decided in Khar’s favour. She has now prayed, in her appeal, that the decree of jactitation of marriage be dismissed and a decree for recovery of dower be passed in her favour.
