Misuse of residential units: PHC asks respondents to submit replies

The Peshawar High Court (PHC) has asked the people who had been served notices for running commercial activities in residential areas of University Town to submit written replies to the court by October 17.


PHC Chief Justice (CJ) Dost Muhammad Khan gave the order while heading a division bench with Justice Mrs Irshad Qaisar. He was hearing two petitions of the same nature filed by former deputy attorney general Khurshid Khan and Dr Muqeem Khilji.

CJ Khan observed that the case could not be decided in absence of the people served with notices as they also have a right of defence and adjourned the case hearing. He also ordered director general of NAB to collect relevant data and submit it to the court in the next hearing.

In July, a two-member bench had ordered the Town-III administrator to issue notice to all those people found running commercial activities in residential areas. All those served notices were asked to vacate commercial buildings in residential areas before August 29.

The petitioners have also challenged commercial activities at a leased land in University Town where a restaurant, Dewaan-e-Khaas, has been built in violation of rules. The court has stayed further construction on the land; however, existing club members are allowed to visit the restaurant.
