Federal govt asks to be made party in contempt case against Zardari

LAHORE: The federal government on Thursday moved a civil miscellaneous application in the Lahore High Court to become a party in a contempt case against President Asif Ali Zardari.

Zardari is accused of violating court orders by continuing to hold dual offices of being the Pakistan Peoples Party co-chairman and of being the President and conducting political activities at the presidency.

The application was moved through senior lawyer Wasim Sajjad wherein he stated that the federation was made respondent in the main petition but not in the contempt of court petition.

“According to the Constitution, the president is a part of the federation and under Chapter III of the Constitution, the federal government can exercise its power in the name of the president,” he said, adding that the federal government should be allowed to become a party in the contempt case.

A full bench, headed by Chief Justice Umar Ata Bandail, will hear this application as well as the contempt petition on September 14.

Earlier, Advocate Munir Ahmad had filed a contempt petition against Zardari in which he contended that the LHC in May 2011 had declared that president could not hold the office of PPP co-chairman while being the president of the country. Ahmad said that Zardari failed to obey the orders, committing contempt of court.

He requested the court to initiate contempt of court proceedings against the president.

Only Gen Ayub, Gen Zia and lately Gen Mush were army chief, president, and head of their own political party. These PCO judges had no problem with that at all. In fact in each of the above case they aided and abetted the mutilation of constitution and high treason by the generals. All the laws are only applicable for elected leaders while the generals can keep three top positions at the same time with the endorsement of judges.

What is legitimate?

We demand Electricity, justice, rule of law, security, education, jobs, recovery of missing persons, and end of violence, terrorism, and end of target killing. Secure borders and internal peace, food, medicines, water, immediate response in natural disasters and emergencies, and bright future for our children. Are these illegitimate demands? Are these not the duties the government which it is formed for? If the government is not performing its duty is it legitimate anymore? If not then is it legitimate to make these demands from an illegitimate government? I am confused because I have not studied political science like all of those in government.
