Asma Jahangir, the counsel for Haqqani, filed the application in the apex court under the apex court rules 1980 for reconsidering its June 12 order claiming her client had been threatened by powerful forces in Pakistan, who are not under the control of any authority in the country.
The Supreme Court had on July 12 given Haqqani a three-day notice for submitting an application to the court for reviewing its summoning orders.
The review petition is being filed in view of the developments which have taken place after Haqqani left for the United States in late January this year, his lawyer said. Jahangir said that her client had remained in Pakistan after his resignation as ambassador. She added that her client’s family was residing in the US but he remained in the country during the memo commission’s initial meetings.
“By the time, Husain Haqqani left Pakistan on an undertaking to return to Pakistan whenever required by the commission or the Supreme Court, there was no sign of the commission agreeing to travel abroad to record evidence nor was the commission contemplating securing evidence through video link. These suggestions were orally turned down by the commission,” said further said.
Asma also mentioned that Haqqani had also filed an application before the commission and then subsequently the Supreme Court for extending the same video link facility for recording his testimony as had been to Mansoor Ijaz, the chief character in the scandal. But, his request was rejected by the commission without any reason. “At this stage, the presence, in person, of respondent is not required and to ensure such a presence would enormously risky and outweigh by many bounds the requirement of his physical presence,” she added.
She requested the court to reconsider the June 12 order as under the law as laid down whether in the criminal procedure code or the civil procedure code, that the physical presence of Husain Haqqani, at this stage of the hearings, is not mandatory.
Haqqani has also moved a separate application seeking access to video tapes of evidence collected by the commission which had been tasked with determining who authored the unsigned memo delivered to Admiral Mike Mullen.

No one can put his life at stake and same is Hussain Haqqani. After so called memo affair he is not safe in Pakistan. If courts give guarantee of his fool proof security and take this responsibility he will certainly appear but I know courts are never going to do this. They extended this olive branch to Mansoor Ijaz because he is their henchman. Hussain Haqqani should not appear before the court because it is tantamount to take life risk. It is a serious issue courts should allow him to record his statements through video link. Sine this permission was given to Mansoor Ijaz, Hussain Haqqani equally deserves to have this facility. If biased courts do not allow him, he must not appear before courts and let them decide what they want, after all it is pre-decided by judges, all this procedure is a formality.

Ah but Hussain Haqqani was not a dual nationality holder while he was a Pakistani ambassador. HE only had Pakistani nationality. It is his wife who is a suspended MNA that has dual nationality - which is a separate case in front of the supreme court/

Reasons why dual nationality holders should not be in position of authority, and other sensitive positions. Once out of office there can be no checks and balances on them and they can live comfortably outside Pakistan....
Also the SC extended te courtesy of video link to mansoor IjAz is that he is not a Pakistani citizen and therefore not bound by Pakistani laws. He was doing a favor to Pakistan by giving his testimony, albeit whatever his motives
He's nuts if he comes back to Pakistan at this point. He needs to seek asylum in the US until law and order is restored, if ever, in Pakistan.
This traitor must be dragged back to the country at any cost.

Husain Haqqani deserves the same treatment that the Commission has already accorded to Mansoor Ijaz. If the Commission does not show any sensitivity toward his health or safety concerns, it will become abundantly clear that the Commission is being unfair by applying double standards against Haqqani. The Commission should be cautious about making an example out of a slum boy who matured into statesman, solely because his progressive views diverged from the retrogressive agenda the establishment has been pursuing for the last forty years.

Can we trust Asma that as care taker PM she will take the right decisions as she is playing delaying tactics in this case? I am sure she must have advised Haqqani not to return to Pakistan on a security threat. Same as she posed for herself and requested her masters to intervene for her security.
