It may have been a painful experience for Yousaf Raza Gilani to be unceremoniously kicked out from his office – but he has much to compensate him for his woes.
Under the Salaries and Allowances Act of 1974, Gilani is to continue to enjoy privileges, in spite of his conviction. The former premier, like over 20 former prime ministers, will continue to have access to a life-time of completely free-of-charge perks, including cars and a sprawling bungalow with security in the heart of the country’s capital.
The silver lining for Gilani, who lost his honour of being the country’s longest serving prime minister following the Supreme Court’s verdict in a contempt of court case, lies in the absence of laws that address the aftermath of a lawmaker’s conviction. Such laws, like those present in other democratic countries, could have rendered him ineligible for receiving such privileges.
In India, for instance, former prime ministers are usually entitled to six executive-class air tickets annually, a 14-member secretarial staff, office expenses and vehicles. On condition of anonymity, a member of the National Assembly told The Express Tribune that if a lawmaker is convicted by the court, then he or she is treated merely as a former lawmaker.
“There is no such law at the moment which can define whether a convicted former lawmaker or prime minister of the country can enjoy privileges and perks or not.”
Former senator Professor Khurshid called for formulating new laws, stressing that convicted lawmakers, particularly those who have held the position of prime minister, president, national assembly speaker, chief minister, governor and senate chairman, should be deprived of perks if they stand disqualified by courts.
Pakistan Muslim League-Nawaz (PML-N) leader Tariq Azeem also endorsed the idea and said: “Any privilege due to former elected parliamentarians should be denied to those convicted by the courts.”
Azeem also moved a bill titled Salary and Privileges of Parliamentarians 2010 in Senate. The bill was adopted by the upper house, after which it was referred to the National Assembly. The National Assembly, however, terming it a money bill, said it should be introduced in the lower house of Parliament first according to protocol.
The Parliament also recently adopted the Finance Bill 2012. Under this bill, a former prime minister will be provided life-time security, transport facilities, personal staff, and medical facilities. PML-N demanded in its recommendations that such perks be overturned for all former lawmakers. The ruling Pakistan Peoples Party (PPP), however, did not include these recommendations when Parliament adopted the bill.
The monthly remuneration for MNA consists of: A salary of around Rs 23,803; an ad-hoc allowance worth Rs11,903; office maintenance allowance worth Rs8,000; telephone allowance worth Rs10,000; sumptuary allowance worth Rs5,000; and ad-hoc relief allowance worth Rs3,571, according to last year’s figures.

Give him and the rest of the assembly all the benefits they demand. The monthly figure for the salary of an MNA, and the costs of the perks to Gilani are extremely low when one considers the billions they are alleged to have made. Reducing legal perks doesn't even amount to a rounding error in the final calculus.
@John B:
He was a part of Pakistan's establishment. Till he was disqualified by the highest judicial authority of the Land. Now he is no more than a convicted former PM.
The irony is no country in the world has Field Marshals but Pakistan had one self appointed and now Egypt has. None of them have won any battle and despite defeats they have promoted themselves with all the titles and perks. Can anybody tell how Gen Ayub, Gen Zia and current PCO CJ who all have been salaried employ all their lives but their sons have turned into billionaires? What have been the perks of Gen Mush even after he is kicked out? There are few ex-PM but hundreds if not thousands of generals getting huge perks and nobody talks about them, why? Who elected them, when Gillani was convicted the nation elected his son with big minority, but who has elected these generals and PCO judges? No wonders the generals, judges and corrupt families hate democracy and have no respect for the choice of the electorate.
Adding insult to injury.
We deserve such leaders. Recently, when Shah Mahmood Qureshi resigned from his MNA seat, the people elected Gillani's son with over 90,000 votes! Everyone in Multan knows about the familes' rampant corruption and yet we vote for them. This unfortunate, blighted nation deserves what it is getting.
Thats like any other country. So nothing new here.
@Kanwal: Pakistan has never ever had a PM who ridiculed and insulted the SC ! In fact,We have never had a PM who was convicted and jailed for anything . Hence no clause to deal with it .... I guess they didn't think someone would be idiotic enough to defy the courts !!!!
@Rahman Khan: Get real ! Gillani hasn't earned it , it is the fruit of his and his family's massive corruption !
@pAKI: No. The answer ismore aid. Just like it is for every other goverment department in Pakistan. They spend and other countries foot the bill.
Nice and very convenient law, or the absence of this law. whatever. I just want to ask why this clause is not present at all? did we never have a convicted primer minister? or, did we never think about it?
What does PAK want: see him get kidnapped and open his own door?
As a former PM, he is as an establishment in PAK politics not as an individual. He became a PM when PAK was going through turmoil of assassination. Whether PAK likes it or not she has to give the basic dignity to her leaders. Now, whether he has to accept all the perks is upto him and atleast for the next 5 years he will accept them as the politics will be done from his house!
It is a very small piece in a budget.
There's no law forbidding retirement perks to 'convicted' PMs because the framers never expected an activist court to convict a democratically elected PM by overstepping its constitutional mandate and upsetting the fine balance between three state institutions.
Another white elephant to feed from our hard earned tax money. Don't know when these stupid acts of 73, 74 and God knows which year acts would be revoked. Probably never as the elected members would never compromise on their luxuries.
Today saw a facebook pic of Musharaf , labelled as "Oh my Pakistani fellows ,enjoying Democracy ?"
This sort of thing, it sickens me. Not only do the people get away with it, their kids ... themselves begin to have no value for anything besides money. They will shower gifts on people, grow up in a protective bubble only to be used by conniving people. They have no concept of working and that therefore money arrives... They just assume it comes out of thin air. They have also no concept of how to be properly responsible for themselves or those around them, and can't see how, when they eventually inherit their parents' seats, their childhood is mirrored in their adulthood. It's disgusting how messed up people can become.
@haroon ali: You are sadly mistaken about MNA's salary. Look for the hidden cost and the damage they cause to exchequer you will be astonished. 66 % of development fund goes to their pocket.80 PIA tickets, parliament lodge with expenses, preferential treatment in Thana and Airports and hospitals and roads. You can carry anything in your car with black glasses and MNA plate covering the number plate. The list is endless depending upon moral and ethical values the MNA has.
What a joke !!! Manmohan Singh uses his own private car for private use which is a maruti 800. Cheerio
He is an endlessly shameful man alongwith his family....... we need a non biased judiciary to try him and his family for all the reported corruption and debouchery thay have been doing.....I and many of my countrymen's heads have dropped to read this shameful piece of news today. God Bless us!
This is disgusting.
So our liberals like @Mirza who criticize perks the army men get after retirement stays silent when their lovely politicians (even the convicted ones) get.
All perks should be received back from corrupt Gilani. He did corruption alongwith his family.
Basically there is no law for the elite class..
A person convicted and serving 10 years in prison becomes president (This is hight of Justice)
Gillani was convicted before becoming PM and was in jail for 5 years ..Even then flagrant violation of law became PM
For the poor people of pakistan law says even one day in Jail will make them ineligible for any governement service.
Just because He is PM of richest country in the world ....!!!!!
He has made fun of himself and his party.. Than what can do ?
So Why he to leave Pakistan??
PML-N demanded in its recommendations that such perks be overturned for all former lawmakers.---
Nawaz Shareef and other PML- N former lawmakers should voluntary forego these perks & privileges, and continue to press that no one be given such perks & privileges.
It is a flaw in system. Person with such a corrupt background is being given perks. Necessary amendments in law should be made.
Of course, he deserves these perks. After all, he has "served" the country.
A convicted ex PM should be given no perks. He is the most failed PM in the history of Pakistan. His era is the darkest era. No perks for such corrupt person.
An MNA's salary is merely Rs 23000? Even a driver at a multi national company earns more than that. I think an MNA should get a salary of atleast 2 Lac Rs a month.
what he has done for Pakistan that he will enjoy bounty. i wish that people of pakistan wake up and kill these beasts.......plz plz wake up untill nothing is left.....
Democracy is the best revenge, for the people and by the people. long live democracy.
Don't worry, all will be reversed soon.
the question we are asking are legit. however we are also paying money for all the retired Generals and Bureaucrates as well. who will ask them???
democracy is the best revenge
Has Nawaz Sharif refused to take these privileges, in spite of his conviction?
Not recommended.
It is justified for ruling elite. YRG is a poor man and cannot afford a house, car and security of his own. Dear Fellow People!! Please DO cast your vote and cast it judiciously next time. And then we will do their accountability!!! Every single penny will be extracted, no worries!! INSHALLAH!
My dear poor nation Gilian sb earn a lot which sufficient for him and his children for many years to come.
Keep enjoying on tax payers money as reward for damaging the social, moral, economic and fabric of the country. Defiance is rewarded by defiant.
democracy is the best revenge.......... btw, now all the convicted murderers, thieves etc should be given all these perks as well since everyone has the equal rights in democracy
It reminds me a proverb that:-
"A live elephant is worth of one laakh (100000) Rs. but a dead one is worth of sawaa laakh
(125000) Rs.
I honestly do not remember him much as our Prime Minister. Do not really miss him seriously.
Now the poor Pakistani nation shall also afford the expenditures of convicted ex-PM Gillani after termination from his office of premiership.Wow how the rich, brave and prosperous Pakistani nation is or has been now in PPP's regime that it shall support ex-PM to fulfill his kingly, lavish and luxurious life styles' expenditures!!!!!!!! Greatest poor and common Pakistani man long live..........
He had the chance to leave with some dignity, but he has failed.
" The former premier, like over 20 former prime ministers, will continue to have access to a life-time of completely free-of-charge perks, including cars and a sprawling bungalow with security in the heart of the country’s capital " Question: AND.. who's going to pay for his & other 20's luxuries...?? Answer: More TAXES!
His revenge on pakistan.
