The court was hearing a suo motu notice of media reports that a Kohistan jirga condemned four girls to death for defying tribal customs.
Earlier, Chief Secretary Khyber-Pakhtunkhwa Ghulam Dastagir informed the Supreme Court that a helicopter had gone to bring the girls and asked them to wait till 6pm. However, the girls were not produced before the court. Dastagir and Attorney General Irfan Qadir cited several reasons for their failure to bring the girls to the court, including the rugged terrain and language barrier.
The Supreme Court also stated that if the authorities fail to present the girls, they must then bring the jirga members - those who issued the death decree - to the court.
Chief Justice Iftikhar Muhammad Chaudhry had ordered the chief secretary K-P to bring the girls to the court in a helicopter.
According to reports, the four girls, along with two other men, were declared ‘ghul’ (fornicators) after they were allegedly caught on video singing and dancing together at a wedding party.
During the hearing, officials from Kohistan’s dictrict administration had appeared before the court, including the chief secretary K-P, Deputy Inspector General of Police Hazara, Commissioner Hazara Khalid Umarzai.
They had informed the court that they had failed to get in contact with the girls despite several attempts, however, they said that the girls were alive.
They had added that the culture of Kohistan does not allow men to contact girls freely.
The court had told the officials that if the girls were alive then they should take someone reputable to the girls in order to record their statement.
When the chief justice was issuing the orders, the two men accused of filming the video and uploading it on the internet – Bin Yasir and Gul Nazar –were brought before the court by the police.
Nazar had revealed before the court that the girls were killed.
The chief justice had expressed concern over the statement and had asked DIG Hazara as to why there were conflicting statements in the case.
He had said that the interior ministry was ready to extend any kind of support required, whether it was helicopters, Frontier Corps (FC) men or army personnel, but the girls should be brought before the court.
The chief justice had earlier adjourned the hearing till 2pm.
The court, however, did not record the statement of the other accused, Yasir.
Civil society members had pleaded to the court that the girls were alive and that the court should gather evidence regarding it.
The chief justice had asked what had happened to the inquiry that Rehman Malik had initiated. Attorney General Qadir had informed the court that the interior ministry had provided a helicopter and that the civil society members “could meet the girls if they wished to.”
He had further informed the court that the families of the girls were not willing to send them. He had added that so far, all the people who have been investigated regarding the video said that the video is forged.
Chief Justice Chaudhry had told AG Qadir: “You always inform us about the code of conduct, apprise us about it in this hearing, too.”
Girls were 'slaughtered' on May 30
Speaking to the media on the premises of the Supreme Court, Muhammad Afzal, the brother of Yasir and Nazar had said that the girls were “slaughtered” on the eve of May 30, 2012.
Afzal had said that if required, he was ready to swear by the Quran “a thousand times over.”
He had further revealed that he and his brothers were facing threats to their lives and alleged that the DIG and commissioner Hazara were planning on “killing them”.
“They are carrying out proceedings against us, but what about those who slaughtered those girls?” he had questioned.
“The only relation that I and my brothers have with this whole incident is my brothers filmed the celebrations of our uncle’s wedding,” he said.
He had said that the girls did not dance, only the men danced, while the girls clapped.
Afzal had said that the fatwa against them and the girls was given a month back by Maulana Javed in Mansehra. “After giving out the fatwa, they sent out 40-50 men to hunt us down in different areas including Battagram, Abbottabad and Mansehra.”
Revealing that the girls belonged to the same family, he had said, “Three out of them were cousins, while two of them were closely related.”
He had identified them as Bazgha, Shaheen, Amina and Begum. He could not recall the name of the fifth girl.
Afzal had further revealed that he knew four men who had seen the girls getting slaughtered.
The video had caused a furore in the community, which felt the video had tainted the honour of the tribeswomen. According to sources, elders of the Azad Khel tribe had summoned a jirga at Seertaiy village, which sentenced the four women and two men to death.
DIG Hazara assures brothers of security
DIG Hazara had assured Afzal that he will be provided security by the police and had said that he appreciated that he had stepped up and spoken for justice.
“You come to me, on my responsibility, and get your statement recorded. I assure you that you will be provided security,” the DIG told Afzal.

It was a conspired case, which culminated after Farzana Bari & others' meeting with the girls.

Maulana Javed from Mansehra who gave the fatwa should be beheaded in public and send him to Allah who will ask him who gave him the power to kill those 5 girls for clapping. These people are a disgrace to our beautiful religion
@Freedom Seeker: my dear, it is about the lives of the people , not publicity. If our national interests do not include the lives of the poor then they are of no use . We as common citizen dont hv interest in some one's dual nationality, or some memo gate type scandals, or mehran scandal. What we want is justice to the poor and common citizen. you are right the CJ should not get involved in such issues, but it is also a fact that neither our incapable govt is doing anything to protect the lives of common people nor our lower courts are so effective. Thus, Cj has to take suo moto of such cases, which are symbolic and the verdict in such decision affects the country overall. By d way, ur "name" doesnot contradicts ur way of thinking. :P
I hate to pop the balloon for people who are excited and want severe punishment for the murderers. This SC which had taken Suo Motu against the gang rape of M. Mai has released them all except one. One man convicted of gang rape! M. Mai's appeal in the SC is still on wait. This would be the repeat of the above case. The jirga members would be free to repeat it again and again knowing full well that they can get away with that. There would be a few populist and political outbursts by the PCO judges in the court but no real punishment for the killers, the mullah and the jirga. I hope that I am wrong but if history is my witness it is not going to be fair.
@Asif: When was the last time a jirga and its members were held responsible for any crime they committed? These jirgas are only to go after the weak in the society. Its an evil religion they are following.
The jirga must be dealt and given punishment according to Sharia Law. The men who carried out this crime must be dealt accordingly as well. These tribesmen are not ..... above the law of Almighty Allah? Pakistan Army/FC and other agencies must upheld the law of the land and deal this with iron-fist otherwise there will be more chaos.

Actually it is worse. They were not even dancing. They were just clapping. Also the men were sentenced to death because they videotaped a family wedding.

We are descending into the depths of chasm of religious madness. I think that the girls have been murdered brutally in the name of Islam and whoever gave the fatwa about the whole matter is still at large. Such incidences are detrimental for the image of Islam across the world. Whatever these girls were doing was being done in their house and Islam does not allow to violate the sanctity of one's four walls. Alas, we have totally forgotten the true lessons of tolerance and forgiveness taught by Islam and are blinded by bigotry and hate. Allah help us all. I am sure that Allah will do justice with those who are misleading the masses in the name of Islam.

Man I am leaving this country if PTI doesn't come into power,,, this is all Government failure, Law and Order responsibility lies with the government. How many Chief Justices do we know of other countries? because their Police takes the first action and then Government starts prosecuting... But here We only see CJ Iftikhar taking notices... CJ is the last man standing...!

I saw the 'dancing' video on the Youtube. I request everybody to go watch the video on the youtube. All that these four girls were doing was clapping! Yes! you read it right, they were just clapping!!!! It is time to come hard on these culprits who would sentence girls to death for the crime of 'clapping'
In Kohistan and chillas only DOUBT is enough to kill women- if you please go inside Kohistan not on KKH road like ( Khandia , Jalkot and Dubair velly) villages and some villages in Gilgit Baltistan like ( Daril , Tangir and chillas) then you know that were women are treat like owned property and no girls in these village have the right to go to school and hospital alone until accompanied by man, i personnely now several women have been killed just on the doubt that she is involve in a relation with man, and in some causes women killed in one village and man killed in other just on doubt. More on that as per local tradition and miners the women who found in doubt or confirm with relation with a man should be killed and no one going report the police this a normal routine in the area.
SC should have ordered to bring Maulana Javed, who issued the fatwa, to be brought before him and chanrged with running private militia and prison.

I hope my statement is not true.. but it seems like the girls have been killed already, because these kind of Jirgas don't give enough time to the person convicted.

If the girls are found to have been killed, then a murder accomplice charge against DIG and Commissioner must be initiated. As for the Jirga, I dont think anything against can be done against them given the weak state of sovereignity.

Is CJ head of Judiciary or head of Administration. What is the role of GOVERNMENT in Pakistan. Does it exist for the common man. What have the Provinicial Governor and the President done in this case.

Unfortunately it looks true that all the alleged five girls have been killed. What a brutality in the land of pure that too in 21st century. If killing is proved then it is the duty of SC to bring the culprits to an exemplary task to avoid repetition of such incident in future. What bad name once again the motherland will have globally is awful.
PM Gillani govt and the Lower Courts arent doing their job and CJ have to take notice of everything.
I really hope the girls are still alive. That jirga and that cleric should be made an example of. The CJ and the executive must do more to protect women, religious minorities etc, so that tribalism and extremism can be wiped out!
Now, those who were saying this video is fake and this is a drama to malign Islam, why is CJ taking notice of this video if this is fake?
Kohistan's culture does not allow the police to contact the girls and their families are unwilling to send them to the supreme court. Does the Republic of Pakistan retain any control at all ANYWHERE in the country?
It doesn't matter if someone is unwilling, the orders of the Supreme Court of Pakistan MUST be enforced. Do a commando action if you have to.

The Chief Justice must get rid of this attorney general who is always out to create a scene, rather than fulfilling his legal obligations.
I wonder why CJ involve in such issues personally. There are lower courts which can do all this. Hundreds of high profile and national interest cases are pending in SC for decades without even put in SC timetable. Better for CJ to leave such poor publicity cases and focus on national interest and started to give verdict on pending cases.
Unless and untill Honourable CJ does not take action against the ruling elite nothing will change. "Target the root cause of problem"
