Media reports of the alleged killing of four girls and a fifth for being ‘an accomplice’ were presented before the chief justice today by the registrar of the Supreme Court.
According to an exclusive report by The Express Tribune, the jirga had declared four women and two men ‘Ghul’ (fornicators) after they were allegedly caught on videotape singing and dancing together at a wedding party in Bando Baidar village of Peech Bela union council.
The video caused a furore in the community, which felt the video had stained the honour of the tribeswomen. According to sources, elders of the Azad Khel tribe had summoned a jirga at the Seertaiy village, which sentenced the four women and the two men to death.
The chief justice ordered Attorney General Irfan Qadir to find out if the news reports about the incident were factual or not.
He further said that if the reports were bogus and such an incident never occurred, then the girls be presented before the court the same day.
The chief justice said, “This incident is a gross violation of fundamental human rights.” He added that the Supreme Court has already given directions against the jirga system.
The police had registered an FIR against two brothers, Bin Yasir and Gul Nazar, for allegedly making the film and uploading it on a video sharing site.
Earlier on Sunday, Yasir and Nazar’s elder brother, Muhammad Afzal said the women were called back from their in-laws and locked in a room.
He added that their family members subjected the women to severe torture – threw hot water on them, beat them, and kept them in isolation for two months.
Afzal also said that the jirga sent over 30 men to kill one of his brothers.
Girls are alive?
An initial inquiry report, investigating into the controversy, has been presented to the K-P government. According to the report, the five women are alive and were currently living at their respective residences, Express News reported.
Commissioner Hazara Division Khalid Khan Umarzai and area Deputy Inspector General (DIG) visited the village of Sardia in Tehsil Palas, where they met the parents and families of the allegedly killed women. They also recorded the statements of the five women, while they were veiled behind a curtain.
The report added that the video was doctored, via a conspiracy due to personal enmity, to make it appear as if the men and women were in the same room when they were actually in separate rooms.
According to the investigative team, two brothers of the alleged perpetrator [who made the video] have been arrested, while efforts are underway to arrest the the latter, who is still at large.
Earlier, Khyber-Pakhtunkhwa Information Minister Mian Iftikhar Hussain also said that the reports were “wrong and baseless”.

Only fools, religious fanatics or professional truth manipulators can consider these statements to be proof.

The Supreme Court of Pakistan should term the Jirga system as illegal and against the constitution of Pakistan.
All Jirgas should be banned completely once and for with immediate effect. No Jirga should takes place any where in the country.
People who may come to know that the Jirga is going to take place should report the matter to the local police station and all the people comprising of Jirga should be arrested. This should be termed as a non-bailable offense and equivalent to comprising of illegal courts without any education authentic qualification of the law.
The Jirgas should also be termed as running parallel private courts which neither is allowed to form under the Constitution of Pakistan, nor it is according to the aspiration and injunction of Islam.
The difference between an lawfully constituted court and a Jirga is that a lawfully constitute court gives right to the accused party the right of self-defense, whereas the Jirga does not provide the right of self-defense to the accused party.
And thanks to our brave-young media for distorting the facts.
At least media should stop its adventurism on kohistan and let the CJ dig out the reality. I feel pity for those bloggers who have just finished thier blogs on this subject and was almost ready to upload. Well, you should try something else now.

Yesterday I spoke to one of Police officer of that area about this issue, he laugh and told me that this a normal cause only some NGOS give it a big picture Kohistan has a totally different and unique culture from rest of Pakistan, in kohistan a wedding cuble can not meet each other till 3rd day of wedding , there no male and female has separate houses, a women not allowed to wear clothes that show their body parts only Hijab are allowed, so many deep and old things are there, CJ have to respeact the tradition and culture of the locals also don’t take every things in moderation terms…

Sorry. I do not think you have read my post. I was not comparing apples to oranges as you are. I also do understand he is not an executive and accordingly, did not bring up issues such as electricity. There were 2 points I made: 1) Why is he inconsistent about whether media can be used as an evidence or not? 2) If army disobeys Lahore High Court for 6 years why is it not held up for contempt of court the way he has held civilians accountable for contempt of court? Both these issues are directly related to his role as a chief justice and point to inconsistency in the approach he has taken. This judiciary maybe independent but it is not unbiased. That is a pity.

His hearing in Mush era cases(Steel mill) and missing person, Baluchistan case means this silly PPP conspiracy of him being a army stooge is laughable. So most of the comments are based on grievances against judiciary. For the info of most of you above, this judiciary has been the most transparent till now. You guys would have made similar noise if he would not have taken the notice. This is what you guys are good at ... So just sit back and see what happens.

Unfortunately the elective representatives you are talking about have no moral or ethical grounds nor they have the administrative minds to manage things. Turkey is the best example; if elected government do things right, people will stand by their side to even change the core of constitution. The CJ is getting quite weird. He is stepping on things irrelevant to his job description. He might have this crazy idea that people of this country want him to declare himself the long awaited "Khaleefa" with Rana Sanaulah as his campaign manager and Ahmad Ludhianvi as his "Qazi-ul-Qazat" or something like that. may be a sou moto once a year was sufficient you can't bring reform by suo moto actions especially when they are seen asoliticaly motivated and biased to the government security forces may be responsible for atrocities but you can not fight with them in public

So the CJ DOES take notice of media articles. But when it comes to Lal Masjid case, all the available television footage of people shooting at security forces from inside the mosque do not constitute evidence. Pretty selective about when media constitutes evidence and when it does not.
Another example of selective administration of justice.
