The Former law minister and advocate Babar Awan, appearing before the Supreme Court for the hearing of his contempt of court case, equated his trial to that of Dr Afia Siddiqui with mere submission of an evidence.
Dr Siddiqui had been found guilty by a US federal court for assault with the intent to kill her American interrogators in Afghanistan. The charge carries a maximum life term.
On Tuesday, a two member-bench of the apex court comprising Justice Ejaz Afzal Khan and Justice Athar Saeed resumed hearing of the case. Awan objected to submission of evidence by the attorney general and requested the bench to note his objection in the order regarding its admissibility.
In the absence of his counsel Barrister Ali Zafar, Awan said that he did not want initiation of a trial like that of Aafia Siddiqui, in which a trial was initiated based on a single piece of evidence. Justice Ejaz Afzal though told him not to draw parallel with Dr Siddiqui’s trial.
He objected to Babar’s arguments and said that under the process and procedures, besides conventions and code of ethics, his counsel should place contentions on his behalf. Responding to a query of Justice Ejaz Afzal, Babar said that under conventions and keeping in view the relationship between the bench and bar, Awan maintained he had already adopted a path and submitted his apology.
Attorney General for Pakistan Irfan Qadir submitted a compact disc (CD) containing the press conference of December 1, 2011 addressed by Babar Awan over the memo issue and recorded his statement. Qadir told the bench that he was not an eye witness in the case, so he could not produce further evidences.
Justice Afzal told him that being a public prosecutor, it was his duty to argue the case further. Upon the bench’s inquiry, Awan requested that he be provided at least eight weeks to compile evidences and arranging defense witnesses. However, the bench was less than convinced with Awan’s argument and adjourned the hearing till June 27.

@Raj - USA: please shuttup.. Aafia is our soul... she is more than a sister to most pakistanis... so ugtohe ll
@AnisAqeel and Zubair - the intention is not to prove anything or anyone right or wrong - in Aafia's case the facts speak for themselves, not the rhetoric and misconceptions of the mainstream media and all the lies that go with it. Positive engagement and positive discourse is important to work towards a common goal that Zubair's comment alludes to.
@Anis and Brother Inayet, Its seems like very different views have arisen, nobody can say they are incorrect, your view is determained by your knowledge on the topic at hand. Brother Anis you suggested unending research and brother Inayet you provided a report filled with more information regarding Sister Aafia. This is what is needed, the exchange of information to work towards a common goal, the goal of becoming aware,of seeking the truth. Once the wool has alluded our eyes we can begin to see injustice for what it is,we can feel compassion for those afflicted and we can speak out against those calling the shots.
@Inayet: Okay brother I am wrong and you are right. Thanks for enlightening me!!!
@AnisAqeel - you got it all wrong my brother - Aafia chose the positive path through Dawah and Education wanting to make a difference through an educational revolution to improve the lot of women in Pakistan. Even an athiest like Naom Chomsky referred to Aafia as an institution on her own who would effect change wherever she goes. The education reform she wanted would have changed the course of history in Pakistan and elsewhere. You need to see the wood from the trees before drawing your own assumptions and conclusions. I suggest you read the report of the International Justice Network disproving every allegation and crime that Aafia has been accused of.
@Inayet: @Zubair: If someone is convinced that man has not reached on moon, Twin Towers were destroyed by USA or Jews by themselves or Osama B. Laden was an American planted person and Osama was killed years ago before May 2, that is just a drama and blaw blaw blaw. I can only borrow the words of a revered poet that these people won't change but change the Quran (for their interests). My brothers we only need education (education with unending research) and economic strength that we can not have without education other than that our going into denial of facts won't help. I believe even Allah (SWT) will not help us if we continue path of denial and changing reality. Sister Aafia was talented (no more) and could have used to serve fellow Muslims and Pakistan in a positive way that she chose not to and adopted the negative path.
Well AnisAqeel, If you review the evidence brought forth against her you will see how ludicris the allegations are. The goverment think the American people to be absolutely stupid. They know how gulible you are and howmuch faith you have in them so you and a large majority of America fall prey to their lies. Research indebt the Aafia case and her innocence will blind you.I am a brother from South Africa and trust me that its not only the Pakistanis who "adore" sister Aafia, we held a rally here a week ago and had turn outs of no less than 20 000 people accross the country, and not everyone here is even aware of her case. If a 3rd world country, with "uneducated poeple" are able to tell a truth from a lie, then why cant you.
@Malik: @Raj - USA: She is a proven terrorist accomplice (and a wife of a terrorist) and her role was defended by high profile lawyers (with seven figure Dollar cost from tax payers money) but could not save her for the evidence and her own testimonies that were so compelling that even the full support (legal and financial) of Pakistan Embassy could not save her. It was an open court case without any tainted evidence. A terrorist can not be a Muslim, at least that much Islam I know and terrorists are always adored by a very few 'Muslims from Pakistan'.
@Raj-USA: She is a Muslim woman from Pakistan falsely accused and tortured, seperated from her kids and treated like an animal in prison ... this is enough for Muslims from Pakistan to adore and support her ...
Raj - its not what Aafia has done for Pakistan, its what she was capable of doing and what she would have achieved in changing the face of education in Pakistan.
I am totally at a loss as to why many in Pakistan adore Afia Siddiqi. What has she done for Pakistan ?
It is ironic to see that the PCO SC is not in a rush to convict Babar Awan who is not a PPP leader anymore. However, the SC was in a rush to convict the PM in a hurry. As Bilawal demanded in his speech in early April "why is Awan not convicted?"
