Durrani on Wednesday submitted a counter affidavit in response to former army chief Gen (retd) Mirza Aslam Beg’s statement in which he blamed the ISI for ‘corrupt practices’.
Durrani, defending his position, insisted that the role of ISI and MI to distribute funds among various politicians and political parties was lawful, and he added that Beg was also informed about the plan. “The ISI did have the mandate to carry out this task, which has often been reiterated during the proceedings of this case,” the former spymaster maintained.
“The decision to disburse election donations through the ISI may well have been taken by then president Ghulam Ishaq Khan, who, having handpicked the caretaker government including its Prime Minister Mustafa Jatoi, was de-facto the chief executive. The operation was therefore lawful and it followed an established chain of command,” Durrani said.
“All accounts were maintained by officers belonging to the various MI detachments, and funds were placed in temporary accounts and the details can be provided on a confidential basis. Only after the disbursements were over, the balance was transferred to a special fund of the ISI,” Durrani held, adding that “since records were meticulously maintained, all transactions can be accounted for.”
Beg had filed a fresh statement on May 10 wherein he had tried to absolve himself of any involvement in the distribution of funds to various recipients. Durrani said that “to put the record straight: General Mirza Aslam Beg, as the army chief, was right from the beginning on board in this operation; both in the process of issuing instructions, as well as overseeing the disbursements.”
Durrani, establishing the origins of his orders with then Presiden Ishaq Khan, said, “in fact, I received my initial orders to organise distribution of election donations (through president Ishaq Khan). Though the subsequent instructions were at times conveyed by Ijlal Haider Zaidi, a member of the president's election team, I kept the army chief fully informed.”
Besides Beg’s reference on the subject, the petitioner, Air Marshal Asghar Khan, in his letter dated January 30, 1999 to the chief justice acknowledged that “the charter of the ISI makes it clear that it can be used by the chief executive of the country to finance political parties”. Then Chief justice of Pakistan, Saiduzzaman Siddiqui in his order dated June 16, 1997, was pleased to refer to the documents placed before him by the then attorney general.
Durrani maintained, “as I had stated when called upon by the court to do so on March 9, 2012, I do not wish to merely take cover of the mandate, or of carrying out orders from the competent authority. I believe that as a general of the Pakistan Army, I also have to take responsibility for my action.”
The general sought a private audience, or if not granted, then to submit his reasons in a sealed envelope. “In this case, I followed orders convinced that it was in the country’s best interest. I seek the court’s permission to explain my decision on a confidential basis; or if it pleases the court, to submit an ‘eyes only’ paper on the subject.”
He said that the institution of the ISI was brought under political control way back in 1975. According to Beg’s affidavit dated February 23, 1997, a political cell was created in the ISI by the then prime minister Zulfikar Ali Bhutto.
“Be as it may, ISI as an organisation responds to multiple centres of power: the president, in his capacity as the supreme commander of the Armed Forces; the three service chiefs and the chairman JSHQ; and indeed the prime minister. In practice, however, the army chief wields more power over the ISI than any of its other ‘bosses’; not only because of his extraordinary status in the national polity, but also because most of the ISI’s senior appointments including its director general are serving soldiers,” Durrani explained.

What a country! Generals distribute public money among politicians in the best interest of nation for rigging their (nation) votes. It is the time that SC order Court Martial of all such x-Generals in the best interest of nation.

There are oaths by the soldiers in every country and then there is Pakistan. In the US if a general orders a low ranking soldier to arrest a common citizen without any reason, he would refuse the order. If the general orders the arrest or insult of any elected rep or senator, the soldier would arrest the general for going against constitution and his oath of office. The small difference is they take oath to uphold the law not the unlawful orders from the superiors.

I hope the Supreme Court finds both Ghulam Ishaq Khan and Mr Duranni , guilty of subverting the constitution by rigging elections, the constitution they had taken an oath to preserve and protect. Its a hig act of treason and hopefully the SC will deliver justice.
It has been proved that 2007 polls through which present Govt came into power were too rigged, 35m out of 80m were fake votes.( democracy was restored through fake votes) Once HONOURABLE CJ did not take notice of this event how can we expect him to decide on cases that are 16-18 years old. It is the time that these self-styled political bosses be brought to justice. Post-retirement Court Martial is the only way. Also strip them of their ranks publicly so that future 2nd. Lieut may learn the lesson that the country is not their inherited property. It belongs to all those who pay taxes but have been pushed back rather slapped every-time they asked for their rights. Such alliances, according to O’Donnell, come into existence for two reason: to contain the growing mass discontentment; and to encourage import substitution industries (ISI). This in turn strengthens the hold of emerging bourgeois/capitalists over decision-making process. Ghulam Ishaq was from the civil service (not a CSP) but always claimed himself to be Dean of the civil service. The gentleman was quite a character all through his career in the civil service and then in politics. I better not say anything more.
Rigging polls in 'national interest' ! Even Sadaam Hussain, would not have ever said that. Now remember, in the so called referendum under Musharraf, he got 98% of the votes. That would mean massive rigging. Who did that ?

It will be unfair to put all the blames on military and the spy agencies of the country.After all they gave the country ZAB (Gen Ayub Khan) ,Nawaz Sharif and yousaf Raza Gillani( Gen Zia) and many other lesser weight politicians.Assuming all Generals are put behind the bar (which is unlikely ) ,will that eliminate corruption?The answer is big NO because we are a feudal society where money or muscle or both matter most.Go through who is who of the assemblies and you will find princelings who can't see beyond their interest.If national interests are to be protected we have to pay the price. The spy agencies around the world particularly developing countries have been using tax payers money for achieving their objective.

If the politicians can't control it, they should come to streets rather than gathering the remnants of the government. After all they are always dying to get to the streets for their political motives all the time. I am not a big fan of ISI but the point is, if politicians wanted (or were capable of), they would have brought the establishment in line. We have seen that in Turkey. Well.... even if so.... if the PPP had won.... we became the 2nd most corrupt nation by 1996 when the PPP was in government.... they still remain like that today. So I doubt it would have made much difference even if the PPP had won in 1990- I think it would've been worse.
It is a simple case of treason against Pakistan. But who can go against the mighty generals?

It is about time that Military and ISI stop creating "Leaders" in the interest on nation and let the street decide on next leader. We will stumble on the way but sooner or later, people will start differentiating among the right and wrong. I am sure now people know how corrupt PPP is and hopefully it will be wiped out in next elections ! Let the people decide their fate ..

Gen. Durrani appears to be more candid in his submissions but someone is telling a big lie by disowning any responsibility--be it Gen.Baig or ISI.The Supreme Court should make an example of the errant parties so that in future the state is not made a hostage to executive manipulations for political ends.

Whether it's PPP or PML-N this is a fact that since 1988 they always came into power by rigging in the elections with the help of agencies, the only exception was 2008 election where both parties got sympathy votes and PPP was the major shareholder of public's sympathy due to bibi's death.

Glham Ishaq was establishment picked President , so either way , it was military establishment which manipulated elections in the name of national interest to stop moderate forces like PPP from winning the elections to ensure that their created brigades of private jihadi groups and other fanatics in 1980s, were remained intact for which are still paying the heavy price . It's shame that our Generals have failed to win any war the we have fought with India but successfully poised its own society with religious extremism and made Army look like a political party more than professional fighting force.
As Imran Khan implied that if our politicians were totally honest, the military establishment would have been well under control.
When these politicians need ISI & MI, they use them by exercising their authority being in power and when get thrown out, they blame them. Wish we had politicians who would do anything to accept whatever the outcome of the elections (any elections) be and stop using these agencies to manipulate the processes to get their desired results.. Wish we had agencies who had balls to say no even to the President of the Islamic Republic of Pakistan to the orders regarding manipulating the politics & state affairs.
