The bench found Gilani guilty of contempt of court for refusing to reopen corruption cases against the president, but gave him only a symbolic sentence of a few minutes' detention in the courtroom, while he did not receive any jail term.
“For reasons to be recorded later, the prime minister is found guilty of contempt for wilfully flouting the direction of the Supreme Court," said Justice Nasirul Mulk.
A seven-member bench, headed by Justice Nasirul Mulk announced the verdict and convicted him for violating Contempt of Court Ordinance 2003 section 5 and the charges framed against him were for willfully disobeying the court's orders and ridiculing it.
The court cited article 63 (1) (g) of the Constitution and observed that the premier might face consequences under it.
The judicial bench exited the courtroom as soon as the verdict was announced.
The Article 63 (1) (g) of the Constitution says:
63. Disqualifications for membership of Majlis-e-Shoora (Parliament).
(1) A person shall be disqualified from being elected or chosen as, and from being, a member of the Majlis-e-Shoora (Parliament), if:-
(g) he is propagating any opinion, or acting in any manner, prejudicial to the Ideology of Pakistan, or the sovereignty, integrity or security of Pakistan, or morality, or the maintenance of public order, or the integrity or independence of the judiciary of Pakistan, or which defames or brings into ridicule the judiciary or the Armed Forces of Pakistan.
The premier was charged with contempt by the apex court in February for refusing to write to the Swiss authorities to ask them to reopen graft cases against President Asif Ali Zardari.
Minister for National Regulation & Services Firdous Ashiq Awan said that a special cabinet meeting will be convened which will be chaired by Gilani and President Zardari will also attend the meeting, who arrived in Islamabad on Wednesday night.
The session will be attended by chief ministers and governors of all provinces except Punjab Chief Minister Shahbaz Sharif.
Awan also said that the verdict will be appealed in the court and that a petition will be filed for it.
“This is a historic day. The court has declared a lawmaker a lawbreaker. This is weakening democracy in Pakistan.”
Earlier, with rose petals being showered at him, Gilani was escorted by the members of cabinet to the Supreme Court.
Gilani was accompanied by his son Abdul Qadir Gilani, Interior Minister Rehman Malik and other members of the cabinet.
The prime minister has appeared twice before in court and has maintained his innocence throughout, saying he had done nothing against the rules of business. Aitzaz, meanwhile, had argued that the bench was not eligible to hear the case as it had taken the notice itself.
During the hearing, two following two orders were announced:
First order
For the reasons to be recorded later, the accused Syed Yousuf Raza Gilani, Prime Minister of Pakistan/Chief Executive of the federation, is found guilty of and convicted for contempt of court, under Article 204 (2) of the Constitution of the Islamic Republic of Pakistan, 1973, read with Section 3 of the Contempt of Court Ordinance (Ordinance 5 of 2003) for wilful flouting, disregard and disobedience of this court’s direction contained in paragraph number 178 of the judgment delivered in the case of Dr Mubashir Hasan versus the Federation of Pakistan (PLD 2010 SC 265). After our satisfaction that the contempt committed by him is substantially detrimental to the administration of justice and tends to bring this court and the judiciary of this country into ridicule.
Second order
As regards the sentence to be passed against the convict, we note that the findings and the conviction for contempt of court recorded above are likely to entail some serious consequences in terms of Article 63 (1) (g) of the Constitution which may be treated as mitigating factors towards the sentence to be passed against him. He is, therefore, punished under Article 5 of the contempt of court ordinance (ordinance 5 of 2003) with imprisonment till the rising of the court today.
Former law minister Babar Awan said that according to sub-article 3 to Article 63 of the Constitution, the speaker and chairman of Senate can decide whether the premier will be disqualified or not.
Speaking on the premises of the Supreme Court, he corrected the media reports which were claiming that if the speaker and chairman senate do not take a decision in 30 days, the case will automatically go to the Election Commission of Pakistan, which Awan said was wrong.
He said that the case will only go to ECP if the speaker and chairman senate say that they will not take the decision in this regard.
Correction: An earlier version of this article incorrectly stated that the premier was convicted for violating Article 63 (1) (g) and that he will be disqualified from taking part in elections for five years.

It is so funny that judges are asking Executive to obey order which is unconstitutional in any democratic country then handing over a verdict against him. A monkey brain can make a better judgement. In my and many other people’s mind there is a question that how a common man and Prime Minister is same. A common man case is run for years but Yousuf Raza Gilani was completed in three months, his punishment was only for 32 seconds whereas common man has to suffer millions of minutes.

All eyes are focussed on the PM, Yusuf Raza Gilani. But the man behind the scene, to protect whom Gilani is doing what he is doing, is safe behind the 'constitutional immunity.' It goes without saying that the party that came to power as a result of the NRO, knew very well that its co-chairman was playing on a weak wicket, and unless elected to the post of president, might soon be in trouble. So he was made president. The rest of the story is well known to all. More would follow, but it would be the logical result of the preceding events--the events of the last five years or so, starting with the negotiations between Musharraf and the PPP that led to the NRO!! Now they are setting a bad example. May Allah give them the strength and the foresight to see the right path.

The punishment is just symbolic and a very good decision by the judiciary. If they would have punished him with a jail sentence the ppp would have instantly become a martyr and innocent. This judgement has shown the world their true faces, yet throwing the ball in their courts to see what they do with it. Excellent decision as this will continue the current corrupt regime for the last final few months before they can be thrashed properly in the elections..
The issue with democracy is Pakistan has been that it has always been derailed after a few years, and hence despite all the tall claims of corruption and mis governance these parties return to the people as victors and victims of unfair play .. Convection of prime minister is symbolic but can lead a process of disqualification. At practical it may not affect any situation as it is quite clear that government of Pakistan is not ready to write a latter to Switzerland for reopening the case against president and the process of disqualification may takes too long time by delaying techniques till the time of next election may arrive as the new elections are planed just after few months at the end of this year.

What will be SC next move?? Letter will still not be written. The SC judges have only satisfied their egos with this unconstitutional and hasty verdict. Because of the position Asif Zardari holds, it's not a straightforward matter to write letters to foreign govts regarding his misdemeanors. The supreme court should have first clearly interpreted the immunity clause and then directed the govt to implement it.
In all the judges are playing to the media gallery whilst politicians revel in corruption. The only true solution is early elections, and sensible public voting.

This decision shows the internal guilt and lack of confidence of the judges. How come you convict one person and not punish him as per law. They have just followed their ego and justice now is a forgone conclusion now in Pakistan.

The contempt of court was widely expected. The contempt of court though does not automatically result in being disqualified from the Parliament. For that the judges also needed to state that Gilani was also guilty of ridiculing the judiciary. It is quite unclear that he did so. In other words not following orders was a clear case of contempt butridicule is something else i.e. similar to what Babar Awan did.
Judges were on the warpath against PPP from day one...that was predicted...!
It's good that they only gave him a symbolic punishment (and if I'm reading this correctly, disqualified him from being Prime Minister?) since sending him to jail would have turned him into a political martyr, and God knows we don't want to see his face in the PM House again.
Keep in mind the punishment of 30 sec was for the guilty verdict of contempt of court only. It was not for any other case like ppl are referring to here that he was only punished for 30 secs for looting billions of dollars. that's a whole new case.

The verdict maybe of just 30 seconds. But declaring him guilty makes him ineligible for contesting in elections in the future. Which was i guess the primary purpose of the whole proceedings.

No surprises!! The Judges' Union had pre-trial decision, and the proceedings were just to formalize the proceedings. But one thing is very clear. All 105 PPP-MNAs will have to be disqualified before a letter is written.

The Prime Minister is required by oath to protect Pakistan’s constitution and Article 248 (2) of the Constitution states that the President “shall not be subject to any criminal proceedings whatsoever.” Gilani has a positive defense for his contempt charge, claiming that following the Courts instructions in writing the letter to the Swiss would violate his oath of office.The court can convict him and president should pardon him. The cat and mouse continues. There are no other imp cases to attend to!

Cpongrtulations Pakistan! Now we have a convict as our prime minister. In civilised societies a convict finds it difficult to get any small job even but in our country a convict can get the biggest job and be responsible for billions of rupees of the public.

This is very Reasonable decision by the SC that PM has found guilty and they realised PM for his guilty. The days, months is not matter, the fact is that he should realized his guilty.

A very appropriate verdict by the learned judges. Now the Government can't say that they were wronged by the court and thus try to work it into their advantage. For any self-esteemed politician, the verdict is a slap on the face, but not for this Government, who do no know about integrity, honour and ethics.
Whoa! Does this mean he is disqualified and should immediately quit? Or can he continue?
Why does Pakistani institutions are so callous? Why make a huge spectacle of a simple matter?
Writing to Swiss authorities on court order, won't be the end of the world.

A punishment for only half a minute. I give my children longer punishment than this. The blackmailing of the judiciary by the ppp's people in the media has worked. The poor supreme court was put under too much pressure to give a verdict in favour of the ppp. So,in our country you can get away with your crimes if the media portrays you as the victim.

Any self respecting PM would have resigned months ago out of sheer humiliation and shame, then again you can't lose any respect when you have none. He is the most corrupt PM in our history

What a joke! Punishment for only 30 seconds for looting billions of rupees. The criminals who steal mobile phones are given longer punishment. What was this! The pressure and negative propaganda done by the media against supreme court seems to have worked, the ppp managed to pressurise the judiciary into giving a verdict which they liked.
What a decision? Corruption of billion of rupees and punishment for few seconds. This is Pakistan where law for the rich and the poor and different.
May God protect Pakistan from dynasties.. We need to respects and protect democratic values, and not the individuals..

Now the media people will start personal attacks on the judiciary. The ppp apologists are already repeating their old persecution complex propaganda. Do as much corruption as you want and then when caught, say we are the ones who have been done wrong,play the sindh card and try to divert attention away from the financial mismanagement.
This govt. has looted the country and is now using ethnic bias as an excuse to hide their criminal activities. This victimhood complex of telling the public that we have been wronged won't fool anyone, the pakistani people have suffered enough, no more of this victimhood propaganda.
