Parliament devises law, judiciary just implements it: Chief justice

ISLAMABAD: Parliament devises laws while the judiciary ensures their implementations, said Chief Justice Iftikhar Muhammad Chaudhry while addressing the oath taking ceremony at Islamabad High Court Bar Association on Wednesday.

“Democracy depends on the courts enforcing what the parliament intended, not what the executive wants.”

The chief justice thanked the parliament for showing interest in forming the Islamabad High Court.

He added that the appointment of judges will soon be done according to the law, but reminded that the Islamabad High Court cannot be shifted in Sharia Court’s building.

“Our oath binds us to take every possible step within our domain to maintain peace and harmony in the society,” the chief justice said in his speech.

He also prayed for the soldiers who got buried under an avalanche at Gayari earlier this month.

In most other parliamentary democracies, it is the job of executive and not judiciary to implement the law. The job of the judiciary is to decide cases that come tothe court based on the laws (passed by the parliament).
