Additional District and Sessions Judge (AD&SJ) Rai Muhammad Ayub Marth on Friday directed the Inspector General (IG) of Punjab police to register an FIR against the Capital City Police Officer for disobeying court orders.
The judge passed the direction on a petition which sought compliance with a court order regarding the registration of an FIR against a Sabzazar police SI for keeping a man in illegal detention and handing over his spouse to her mother when they visited the police station to record their statement regarding her alleged kidnapping under Section 161 of the Criminal Procedure Code.
On March 29, AD&SJ Hamid Hussain directed the CCPO to register an FIR against the SI for his negligence. However, no case was registered.
A petition for compliance with the court order was then filed in AD&SJ Marth’s court. AD&SJ Marth had sought written comments from the CCPO but no comments were submitted. The judge then issued the CCPO a show-cause notice. The CCPO did not respond.
The petitioner’s lawyers Muhammad Asif Chattha and Muhammad Malik Naeem said the CCPO was deliberately disobeying court orders. In his direction to the IG, the judge said that that it appears that the CCPO had deliberately not registered the case and had obviously disobeyed court orders.
Bakhtawar Bibi and her husband Mudassar Hussain say they had married of their own free will but instead of recording their statement SI Khalil Ahmed had handed Bakhtawar Bibi to her mother and detained Hussain at the police station.
