In a hard-worded clarification, the army not only rubbished Prime Minister Yousaf Raza Gilani’s accusation that the military and intelligence chiefs had violated the Constitution by submitting replies directly to the court in the Memogate case but also warned of a fallout, which, the statement said, would have “serious ramifications with potential grievous consequences for the country.”
The Inter-Services Public Relations (ISPR) statement triggered alarm in the country, which was accentuated by the fact that Chief of Army Staff General Ashfaq Parvez Kayani had held meetings with top commanders before it was released.
It is learnt that Gen Kayani had made an attempt to persuade the prime minister to retract his remarks before the ISPR issued a statement.
Gilani himself confirmed that Kayani telephoned him about the army’s reaction.
Sources said the prime minister refused to budge from his position, stating that he stood by his statement.
However, the army chose to differ with the country’s chief executive by saying that there can be no allegations more serious than “what the Honourable Prime Minister has leveled against COAS and DG ISI and has unfortunately charged the officers for violation of the Constitution of the Country.”
A military official, who asked to remain anonymous due to the sensitivity of the issue, said that Gen Kayani will further consult close military aides in the next 24 hours to discuss the current situation.
The official added that the army chief was confident that the government will not make any move to sack him. If the government does take such a step, however, the army can explore the option of moving the Supreme Court on the issue, the official maintained.
Interestingly, a petition has already been moved in the Islamabad High Court seeking the judiciary’s order to restrain the government from dismissing military and intelligence chiefs.
Earlier, in a dramatic turn of events, the replacement of the head of 111 Brigade triggered widespread speculations that army was on the move.
However, the ISPR described the appointment of Brigadier Sarfraz as ‘routine affair’ and had nothing to do with the deepening tensions between the military and civil leadership.
The 111 Brigade was instrumental in taking control of key installations in the capital during past military coups.
No martyrs
Another senior official told The Express Tribune that the army will not seek direct intervention to oust the civilian government despite their strong reaction to recent remarks by Prime Minister Gilani.
The official added that if General Kayani had other plans the army would not have issued a rejoinder.
The official disclosed that there was a considered view among the hierarchy of the military that the government was making deliberate attempts to provoke the army to resort to ‘unconstitutional steps’.
“The army is not going to fall in the government’s trap. We are not going to make them political martyrs,” he added.
ISPR statement
It further stated the prime minister’s statement did not take into account important facts, including the fact that the COAS and DG ISI were cited as respondents in the petitions in the memo case and the Supreme Court served notices directly to them.
“This was not objected to by the learned Attorney General of Pakistan,” it added.
It said the army and ISI chiefs sent their replies to the defense ministry and onward submission to the Supreme Court through the attorney general.
The ISPR statement also referred to a meeting between the prime minister and the COAS, where Prime Minister Gilani had publicly stated through a press release on December 16, 2011 that the replies submitted were through a ‘proper channel and in accordance with the rules of business’. No objections were raised before and thereafter, on the legality and constitutional status of the replies, at any time, during the last more than three weeks of hearing of the case by the Supreme Court.
It is also categorically stated that the COAS and DG ISI in their response to the Supreme Court were obliged to state facts as known to them, on the Memo issue.
“The issue of jurisdiction and maintainability of the petitions was between the Honourable Supreme Court and the Federation.”
“Any expectation that COAS will not state the facts is neither Constitutional nor legal. Allegiance to State and the Constitution is and will always remain prime consideration for the Respondent, who in this case has followed the book,” the statement concluded.

India and Pakistan both are riddled with corrupt politicians and it is natural that most of get fed up and look for quick fixes. Sad but true, after so many experiments, the world has not yet been able to find a better replacement to democracy. Only thing we have to wait for people to be vigilant and educated. well the best course for a bright and stable future of Pakistan is not to let this historical moment slip away and stick to democracy once and for all.
Truly the theatre of the absurd unravelling in pakistan. Now no one cares who takes over the country. The USA says it doesnt comment,as Its an internal matter for pakistan. Frankly World should let pskistan sort it out themselves, whether gillani or kayani should be boss. or they muddle along like this only. politics is least on the mind of the poor. they need daily food. if third world countries could progress with ease, they would have become first world by now. Probably it will take Pakistan and other developing countries including China and india another 25 years if not more. The poor have to just rough it out. Meanwhile let the generals and politicians have a ball in life!

No nation in the world has EVER developed under military rule ! Democracy is always bad in the beginning but it is the only answer. Unless Pakistan has 4 to 5 consecutive democratic governments, democracy will not mature.

I think you are correct in your assessment as to my reasons for supporting Zardari. It is really very sad that the options for Pakistanis are very limited - corrupt politicians on the one side and power hungry military who whats the entire population to be their slaves on the other side. India also has this problem of corrupt politicians but some checks and balances are evolving. Still India has a long way to go.
As for Pakistan, IK looks like the best chance, if only he is able to keep the promises he has made. Overall, he has a good team with the exception of SMQ. I really liked what Hassan Nisar said about IK - "Allah Na Karey Imran Nakaam Ho". I sincerely wish Hassan Nisar's prayers are answered and IK is has the strength to keep his promises.

If the PM really thinks that COAS and DG ISI have violated the constitution then he should invoke article 6 or at least sent them home. Otherwise he himself should resign or wait for a exit in the most unfortunate circumstances .
I dont think Army will take over. However, judiciary will do this job for army.

Kiyani last month dismissed coup rumors as speculation & said the army supported democracy ..... & Zardari sahab returned after about two weeks....! This is hard to intimate any thing before, b/c conjectures are never inferable to the reality . & govt should complete its time period, this will be in the favor of Pakistani politics. As Imran Khan too announced that PTI will never support any unconstitutional step by army.

PPP is setting up conditions to be ousted so they can claim the martyr label again. Never again should they be allowed to do that. Let them complete their term or better yet resign as they are too incompetent and corrupt to do any good for this country.

Most of the comments against the civil govt seem to have an inclination towards an Army rule. That will be disastrous. People can complain about PPP govt and demand an early election. But Army has nothing to do with it. It must obey the party in power. Period. They have no business to drag the govt to a fight. It is the opposition's and the court's duty to take the govt to task for any misdoings. Army should be out and out.

i dont understand....there is a democratic process in place that will allow a government to be replaced by a vote of no confidence. If the public is so anti the government why don't the opposition get a vote of no confidence rather than firing a gun from the shoulders of the supreme court.
Having read some of the comments here, since my earlier comment. I just realised that what the Army should do is stand in elections as party and let's all see the votebank's response to them ! As there will be no half measures, either it will get the mandate to run the country as efficiently as it does its commercial business operations or it will fail miserably! But it simply can not sit on sidelines and rule the country, as that's not very democratic ! In event they don't get the mandate, then they have to follow normal procedures as in any democracy, that they are answerable to Defence Ministry and take their orders from them too, hence the permanent fears of coups with be eradicated ! In long term interest of this nation, this matter has to be solved, as the majority of resources simply can not be allocated to support an institution, that consist of less than 1% of the Can people of Pakistan and the Army agree on this, in the Long Term interest of the Nation, Economically and Stability wise??? Otherwise nothing will change in Pakistan for decades to come, that is if it exist in its current form !
COAS and ISI chief are government officials. If PM had "required" that their responses be submitted to court through proper channel, they had the obligation to obey, unless court had explicitly directed them otherwise. The tone and the content of the ISPR statement is not only uncalled for but illegal and unconstitutional. And, reading many of the comments here, I really feel sorry for Pakistan where some officers in an institution (that comes under the government) is not only defying the authority but actually threatening it and "educated" people don't take notice of it.

It is really a new era for Pakistan. In past if anything is said against COS or other big general, the PM would definitely been sacked. Now these big people are highly tolerant, as well as Government is also have big heart. People are breaking constitution and doing illegal actions but they are even holding high valued seats.
PPP hasn't played right games yet there is simply no need for the Army to take over if they have this unconstitutional act in their minds.

I am as opposed to martial law as the next guy but, seriously, what was Gilani thinking? That was an outrageous accusation to make. And it was baseless because Kayani and Pasha were respondents and had to respond to the Supreme Court. I am a DMG officer and can quote dozens of instances from my own experience when federal/provincial secretaries made direct responses to the courts without going through the Prime Minister or Chief Minister. In short, there was nothing unconstitutional about COAS and DG ISI's responses. The government is intent on a "martyrdom operation". This was its latest provocation to achieve that.
It is incompetencies and blunders like these that cause the Army to take the political route again and again.

The Government has already lost its legitimacy after Epic Court verdict. The Government should resign and the country must go for election. The Public will decide the fate the present regime.
This time you have to give it to the army, they did not do anything wrong by replying back to the SC. It is very important for SC to move forward, it will set precedence of strong judiciary, capable of accounting the big lords and generals.
