MLO in jail, victim goes home, lawyer withdraws

A court has sent the doctor accused of being involved in the Jinnah hospital rape case on judicial remand till July 29 while the victim’s lawyer has withdrawn from the case.

The judicial magistrate ordered the police to present a challan after the completion of investigations against Dr Abdul Jabbar Memon accused of raping a trainee nurse at Jinnah Postgraduate Medical Centre (JPMC).

Memon was presented in court on Monday. Judicial Magistrate South Abdul Qadir inspected the accused inside an ambulance and said that there was no need for a full-body remand to get further information.

The nurse has been discharged from the hospital after two weeks. She was under treatment at Jinnah hospital’s neurosurgical intensive care unit. She was sent home amid police protection. She is a resident of Korangi Crossing. Her brain will be operated again after three months.

The victim’s lawyer, Advocate Javed Chathari, has, however, submitted an application to withdraw from the case. He claimed that there is a contradiction in his client’s statements. The court sent Dr Memon to jail on judicial remand till July 29.

Minister sends money for victim

Federal Minister for Minorities Shahbaz Bhatti presented a cheque worth Rs300,000 to the rape victim during his visit to the hospital.

A medical board will be set up by the federal government so that it can analyse all the aspects of this case and present a report on its findings, said the minister.

rosilva one | 14 years ago | Reply The lawyer should be punished for professional misconduct for withdrawing from the case by his professional body ethics committee. It is the lawyers duty to guide his client in law and clear up any misstatements by his client for court proceedings to be effective and quick justice. Laypersons cannot be faulted for not knowing the legal intricacies, that is what lawyers are paid for. Her lawyer should collect and collate correct evidence for smooth prosecution and defend his lady client. One justice for the poor and other justice bought by legal profession for rich is not acceptable.
Imran J. | 14 years ago | Reply Worth noting: The victim’s lawyer, Advocate Javed Chathari "claimed that there is a contradiction in his client’s statements." Isn't this an attorney / client privileged information and, as such, a violation of the law to be publicly stated. This is a pretty bold illegality to carryout unless Advocate Javed Chathari got well 'compensated' somehow. Then, of course, it would be worth the risk. For an attorney to withdraw representation in a case of such public notoriety lends credence to my suspicion that there is more to this withdrawal than what meets the eye. In my view Mr. Chathari's statement in his withdrawal application is designed to taint the judicial system and the public opinion for the future trials and proceedings and make it difficult for the future representation by other lawyers. The victims should be prepared to take legal action against the lawyers and file to have him disbarred.
