Rumours abound as to who’s going to make the first move – the civilian government, or the military establishment? In the possible scenario that the government sacks Chief of Army Staff Ashfaq Parvez Kayani or Director-General Inter-Services Intelligence (DG ISI) Shuja Pasha over Memogate, the army may approach the Supreme Court (SC).
In recent days, General Kayani has had a series of consultations with his top commanders to discuss the current tensions with the government, and possible options to deal with the situation if things go from bad to worse, a source in the military told The Express Tribune.
No coup on the cards
A consensus has been reached that no direct intervention will take place as it had in October 1999 if the government decides to send the army and intelligence chiefs packing, the source said. Instead, they have decided to challenge such a move before the country’s highest court, the source disclosed.
Kayani and Pasha are both working under extensions to their tenure, but under the constitution the prime minister does have the power to remove them anytime. The ISI chief’s extension expires in March next year while Kayani remains at the helm till November 2013.
However, legal experts are of the view that such a move on the part of the government is likely to be set aside by the SC, which is currently examining a petition seeking a judicial probe into the memo scandal.
“They (Army and ISI chiefs) can challenge the government decision in the SC based on the grounds that it is mala fide (in bad faith) to preempt investigations into the memo case,” said barrister Zafarullah Khan, who is one of the petitioners in
the case.
He said there were instances in the past where the apex court overruled such decisions by the government. “And my feeling is if the government goes to that extent, the Supreme Court may not accept it,” he argued.
When approached, the military’s public relations wing refused to comment.
Memogate
Both Kayani and Pasha have taken an entirely different position to that of the government before the nine-member bench of the court on Memogate.
The generals insist that the memo is authentic and needs to be thoroughly investigated while the government has termed it a conspiracy and urged the SC to dismiss petitions outright.
The differences have recently prompted Prime Minister Yousaf Raza Gilani to claim that ‘conspirators’ were out to bring down his government in an unusual tirade against the army.
However, the army chief himself brushed aside rumours of a takeover, describing such allegations as an attempt to divert focus from the ‘real issues.’
What PPP members want
In the face of strained civil-military relations, at a recent gathering of the ruling Pakistan Peoples Party, some members demanded of the government to let the heads of the army and ISI chiefs roll, immediately.
PPP’s chief spokesman Qamar Zaman Kaira reportedly said certain members did raise this issue in the ruling party’s parliamentary committee meeting but insisted those views did not represent the government’s stance.
It is believed that the government has so far resisted taking such an extreme step due to several reasons that include likely resistance from the military and the role of the SC in this entire controversy.
Other factors such as public opposition from the PML-N, which would likely resist such a move, may also force the government to play safe.

No doubt PPP Government is an elected Government but worse than Dictatorship and has disproved its credibility as a true democratic Government and totally failed to demonstrate in accordance to the will and the sentiments of 180 million oppressed and exploited masses of Pakistan starving to death,except looting .
Whatever the legal position of their rumoured sacking and before their subsequent knocking at the door of the supreme court, the people of pakistan will rise against the sacking which will ultimately lead to the removal of this corrupt government.

No, SC cannot ven entertain a petition against dismissal as these appointments are at the pleasure of president and PM excrsises this power on behalf of president. Only question is due process of dismissal may be followed (not required), like giving them an opportunity to defend themselves, otherwise cabinet committee of political affairs chaired by PM is THE AUTHORITY...NO COURTS can have remeady against it.

Both army and civilian Govt should calm down and let the judiciary do their work. It will be lot better. Besides it looks this way that there will be no confrontation.
These people cannot challenge in the SC, as it is the SC itself which has set a precedent which goes against the COAS and DG ISI. If extensions granted by the civilian government are invalid as the SC has held then the same applies to these two, who are on a 3 year (COAS) and second 1 year (DG ISI) extension.
Why should the Supreme Court come to rescue if both of these generals were reprimanded or sacked by the government. Shouldn't the supreme court ensure that the army officers should be obeying the government rather than maintaining a state within state.
In any democracy, Kayani and pasha would not have been given extensions in the first place. and if they decided to spy on their supreme commander, without taking due procedural permissioons, they would have been sacked and court martialed. unfortunately in pakistan, that will never be possible. In effect, the supreme commander is powerless. Indeed pakistan is sliding inexorably to a dreaded future. As world economy drags in 2012, pakistan will have a double whammy of domestic intrigues and awful global challenges. tighten your belts gentlemen, as the GHQ pushes the exit button!

I know a serving General who has 19 official cars & as much drivers. If you sack APK whole lot will be united as their interest will be threatened. So be careful while taking any decision 'Awam ki Quwaat' is very weak as compare to 'uniform ki Quwaat'
Why the govt dont want to investigate the Memo? Is there something wrong with them. If they are right then what is there problem. By resisting the investigation they are giving proof that there is something wrong with them. Kiyani & Pasha are safeguarding the interests of Pakistan in this region. Enemies are trying to remove them fromt the way but they will not succed. We want Pakistan, a peaceful & prosperous pakistan. Democracy is not so important as Pakistan.
If the government has the constitutional power to dismiss Kayani & Pasha and it deems necessary, then the government must get free hand. Their constitutional powers must not be stiffled by judiciary or any other players.

Now the case is in Apex court and no one could dare to commit a contempt,ie.Army could not initiate a coup while Govt could not dismiss kiani and pasha until the verdict is public. the bloggers should have knowledge regarding such issues. the case status-co is thus maintained.
If Pakistan is a Democracy it is the duty of the Legislature and Executive to take whatever decisions it sees fit in running the country. I do not think the Judiciary has the power to stop the democratic functioning of the Government. That said I do not believe the Government has the spine to take such decisions.
PML N = Public and its a biggest threat to the government, they won't take such initiative.
Pakistan's Arm forces are one and only ethical and trust worthy institution left. It must all be a conspiracy to destabalize the Arm Forces and intelligence of Pakistan for the benefit of its adversaries and this civillian government seems to be playing into their. hands. Sometimes power can be blinding. To insult the Arm Force and the security institution is Treason! And must be noted and not ignored.
Disband the whole army. Raise another afresh, trained by American instructors. This one should be liberal and secular -no beards, no cavorting with the mullas, no open demonstration of religious piety.

This will be the grotesque invasion of the last functioning institution of the country. This is the job of the army to protect national security and solidarity which is threatened in Memo case. And this inveterately corrupt and corrosive government wishes to sack them for doing their legitimate and constitutional duty. No Pakistani will accept their further suicide attacks on our state institutions any longer.

Due to simmering tension, the differences between the all powerful military and the civilian govt are growing sharper and a show down now appears to be imminent. The Pakistan juidiciary would have to play an important but impartial role in the near future.
Dismiss Kayani and Pasha immediately for insubordination!
