Hours Later: Job of judge who granted bail challenged

KARACHI:

The judge who ordered Afaq Ahmed’s bail on Saturday, Judge Khalida Yaseen of Anti-Terrorism Court II, became the subject of a petition herself exactly the same day.

The petitioner, Sarkaruddin, through his lawyer, Nishat Warsi, maintained that Yaseen’s appointment, and that of Javed Alam of ATC Hyderabad, were illegal and against the Anti-Terrorism Act. According to him, in the suo motu Karachi case, the Supreme Court had ordered for all ad hoc prosecutors to be removed. According to the National Judicial Policy, serving judges will be appointed to special courts instead of retired judges or advocates. The Sindh High Court was thus requested to declare Yaseen and Alam’s appointment as illegal and unconstitutional. Justice Maqbool Baqar and Justice Imam Bux Baloch heard the petition.
