Halle Berry’s 18-year-old daughter, Nahla Aubry, has been listed as a potential witness in the actress’s ongoing custody dispute with ex-husband Olivier Martinez, following nearly four hours of testimony from their 13-year-old son, Maceo.

According to Page Six, Nahla could testify virtually because she is currently attending school. The hearing in Los Angeles County Superior Court concerns Martinez’s request for a domestic violence restraining order and sole custody of Maceo.

Nahla, whom Berry shares with former partner Gabriel Aubry, previously submitted a declaration supporting her mother.

She said she had never witnessed Berry “hit, slap, choke, grab, or physically abuse Maceo in any way”, according to Page Six.

Martinez’s legal team previously objected to Nahla testifying, arguing that her evidence would be biased and irrelevant.

Other potential witnesses include Berry, Martinez, Berry’s fiancé Van Hunt, school employees, therapists and medical professionals.

Maceo testified behind closed doors on Monday, with both parents ordered to leave the courtroom during his evidence. His testimony remains under seal, and the judge had previously limited it to issues related to the restraining order.

The dispute stems from an alleged confrontation on September 26 involving Maceo and a virtual-reality headset. Martinez alleged in court filings that Berry grabbed their son by the neck and choked him. Berry has denied the allegations, with her attorney describing them as “entirely meritless and deliberately misleading”.

Berry has challenged Martinez’s account, alleging that he “cherry-picked” messages and pointing to a photograph that she said showed no visible injuries.

She has described the encounter as playful roughhousing that became tense, while maintaining that she did not choke or attack her son.

Martinez is seeking sole custody, while Berry wants the restraining order dismissed and the previous 50/50 custody arrangement restored. She has also sought to regain decision-making authority over Maceo’s education and medical care.
