Brian Hickerson's attorney has issued a statement following the death of Hayden Panettiere, asking that the investigation into the actress' death be allowed to proceed.

Hickerson, Panettiere's on-again, off-again boyfriend, was with her when she died, according to a police report obtained by ABC News.

Panettiere died on August 16 at the age of 36. Known for roles in Ice Princess, Nashville and Heroes, she was found unresponsive in Greenville, South Carolina. Police previously confirmed there were no signs of foul play.

Hickerson's attorney told ABC News on Thursday, "Hayden's death remains under investigation and it is important to allow that investigation to proceed. As has been publicly reported, police confirmed there were no signs of foul play."

The statement continued, "Out of respect for Hayden's loved ones and the ongoing investigation, there will be no further comment at this time."

Hickerson and Panettiere began dating in late summer 2018, following her split from former fiancé Wladimir Klitschko. The former couple share a daughter, Kaya.

Panettiere told Good Morning America in a statement in 2020, "I am coming forward with the truth about what happened to me with the hope that my story will empower others in abusive relationships to get the help they need and deserve. I am prepared to do my part to make sure this man never hurts anyone again."

She added, "I’m grateful for my support system, which helped me find the courage to regain my voice and my life.”
